Hadith 5186
أَخْبَرَنَا الْقَطَّانُ بِالرَّقَّةَ ، قَالَ : حَدَّثَنَا نُوحُ بْنُ حَبِيبٍ ، قَالَ : حَدَّثَنَا عَبْدُ الرَّزَّاقِ ، قَالَ : أَخْبَرَنَا مَعْمَرٌ ، عَنِ الزُّهْرِيِّ ، عَنْ أَبِي سَلَمَةَ ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ ، قَالَ : " قَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي الشُّفْعَةِ فِي كُلِّ مَا لَمْ يُقْسَمْ ، فَإِذَا وَقَعَتِ الْحُدُودُ وَصُرِفَتِ الطُّرُقُ فَلا شُفْعَةَ " .
Sayyiduna Jabir bin Abdullah (may Allah be pleased with both of them) narrates: The Prophet Muhammad (peace and blessings be upon him) gave the verdict regarding pre-emption (shuf‘ah) that it applies to everything which has not been divided, but when boundaries have been set and the paths have become separate, then there is no pre-emption.
