أَخْبَرَنَا الْحَسَنُ بْنُ سُفْيَانَ ، قَالَ : حَدَّثَنَا مُحَمَّدُ بْنُ الْمِنْهَالِ الضَّرِيرُ ، قَالَ : حَدَّثَنَا يَزِيدُ بْنُ زُرَيْعٍ ، قَالَ : حَدَّثَنَا أَيُّوبُ ، عَنْ أَبِي الزُّبَيْرِ ، عَنْ جَابِرٍ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " أَمْسِكُوا عَلَيْكُمْ أَمْوَالَكُمْ وَلا تُعْمِرُوهَا ، فَإِنَّهُ مَنْ أُعْمِرَ شَيْئًا فَهُوَ لَهُ حَيَاتَهُ ، وَلِوَرَثَتِهِ إِذَا مَاتَ " ، قَالَ الشَّيْخُ أَبُو حَاتِمٍ : زَجَرَ الْمُصْطَفَى صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنِ النَّذْرِ وَالْعُمْرَى وَالرُّقْبَى كَانَ لِعِلَّةٍ مَعْلُومَةٍ ، وَهِيَ إِبْقَاؤُهُ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَلَى الْمُسْلِمِينَ فِي أَمْوَالِهِمْ ، لا أَنَّ اسْتِعْمَالَ هَذِهِ الأَشْيَاءِ جَائِزٌ إِذَا كَانَ طَاعَةً لا مَعْصِيَةً ، وَذَاكَ أَنَّ الصَّحَابَةَ قَطَنُوا الْمَدِينَةَ وَلا مَالَ لَهُمْ بِهَا ، فَكَرِهَ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لَهُمُ الرُّقْبَى وَالْعُمْرَى إِبْقَاءً عَلَى أَمْوَالِهِمْ لِلضَّرُورَةِ الْوَاقِعَةِ الَّتِي كَانَتْ بِهِمْ ، لا أَنَّهُمَا لا يَجُوزُ اسْتِعْمَالُهُمَا " .
Sayyiduna Jabir (may Allah be pleased with him) narrates that the Prophet Muhammad (peace and blessings be upon him) said: "Keep your wealth with you; do not give it as 'Umra (a type of conditional gift). Because if something is given to a person as 'Umra, it will be his property during his lifetime, and after his death, it will go to his heirs."

(Imam Ibn Hibban, may Allah have mercy on him, says:) The Prophet Muhammad (peace and blessings be upon him) forbade making vows and giving anything as 'Umra or Ruqba, and there is a specific reason for this: the Prophet (peace and blessings be upon him) wanted the wealth of Muslims to remain with them. This does not mean that acting upon these three things is not permissible when it is done in obedience and not in disobedience. The reason is that the noble Companions (may Allah be pleased with them) had settled in Madinah Munawwarah, where they did not own any land, so the Prophet (peace and blessings be upon him) disliked that they give anything as Ruqba or 'Umra. The Prophet (peace and blessings be upon him) wanted their wealth to remain with them because they needed it. This does not mean that acting upon these two things is not permissible at all.
