ذكر البيان بأن إعمار المرء داره في حياته من غير ذكر ورثته بعده لا تكون العمرى للمعمر له-
Clarification that granting a house for life without mentioning heirs does not make it a life-grant for the recipient
Hadith 5139
أَخْبَرَنَا عَبْدُ اللَّهِ بْنُ مُحَمَّدٍ الأَزْدِيُّ ، قَالَ : حَدَّثَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ ، قَالَ : أَخْبَرَنَا عَبْدُ الرَّزَّاقِ ، قَالَ : أَخْبَرَنَا مَعْمَرٌ ، عَنِ الزُّهْرِيِّ ، عَنْ أَبِي سَلَمَةَ ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ ، قَالَ : إِنَّمَا الْعُمْرَى الَّتِي أَجَازَهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، أَنْ يَقُولَ : " هِيَ لَكَ وَلِعَقِبِكَ مِنْ بَعْدِكَ ، فَأَمَّا إِذَا قَالَ : هِيَ لَكَ مَا عِشْتَ ، فَإِنَّهَا تَرْجِعُ إِلَى صَاحِبِهَا " .
Sayyiduna Jabir bin Abdullah (may Allah be pleased with both of them) narrates: That 'Umra which the Prophet (peace and blessings of Allah be upon him) declared permissible refers to saying: "This is yours and after you, it will belong to your heirs." As for saying: "This is yours as long as you live," then the owner of that thing can take it back.
