ذكر البيان بأن الدار التي أعمرت لا ترجع إلى الذي أعمرها وإن مات الذي أعمرت له-
Clarification that a house given as life-grant does not return to the grantor if the recipient dies
Hadith 5137
أَخْبَرَنَا عُمَرُ بْنُ سَعِيدِ بْنِ سِنَانٍ ، قَالَ : حَدَّثَنَا أَحْمَدُ بْنُ أَبِي بَكْرٍ ، عَنْ مَالِكٍ ، عَنِ ابْنِ شِهَابٍ ، عَنْ أَبِي سَلَمَةَ ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " أَيُّمَا رَجُلٍ أُعْمِرَ عُمْرَى لَهُ وَلِعَقِبِهِ ، فَإِنَّهَا لِلَّذِي أُعْطِيَهَا لا تَرْجِعُ إِلَى الَّذِي أَعْطَاهَا ، لأَنَّهُ أَعْطَى عَطِيَّةً وَقَعَتْ فِيهَا الْمَوَارِيثُ " .
Sayyiduna Jabir bin Abdullah (may Allah be pleased with him) narrates this statement of the Noble Prophet (peace and blessings be upon him): "Whoever is given something as 'Umra (a gift for life), it will belong to him and to his heirs after him, because it is the property of the one to whom it was given. The one who gave it cannot take it back, because he has given such a gift in which the rules of inheritance will apply."
