ذكر خبر ثان يصرح بأن الدار المعمرة إنما هي للمعمر له دون المعمر إياه-
Second report confirming that a house given as life-grant belongs to the recipient, not the grantor
Hadith 5136
أَخْبَرَنَا مُحَمَّدُ بْنُ أَحْمَدَ بْنِ أَبِي عَوْنٍ ، قَالَ : حَدَّثَنَا عَلِيُّ بْنُ حُجْرٍ ، قَالَ : حَدَّثَنَا هُشَيْمٌ ، عَنْ دَاوُدَ بْنِ أَبِي هِنْدٍ ، عَنْ أَبِي الزُّبَيْرِ ، عَنْ جَابِرٍ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ لِلأَنْصَارِ : " لا تُعْمِرُوا أَمْوَالَكُمْ ، فَمَنْ أُعْمِرَ شَيْئًا حَيَاتَهُ فَهُوَ لَهُ وَلِوَرَثَتِهِ إِذَا مَاتَ " .
Sayyiduna Jabir (may Allah be pleased with him) narrates: The Prophet (peace and blessings be upon him) said to the Ansar: Do not give your wealth as 'Umra (life grant), because whatever is given to someone as 'Umra during his lifetime becomes his property, and after his death, it will go to his heirs.
