Hadith 5104
أَخْبَرَنَا
أَبُو يَعْلَى ، قَالَ : حَدَّثَنَا
أَبُو خَيْثَمَةَ ، قَالَ : حَدَّثَنَا
جَرِيرٌ ، عَنْ
مُغِيرَةَ ، عَنِ
الشَّعْبِيِّ ، عَنِ
النُّعْمَانِ بْنِ بَشِيرٍ ، قَالَ : طَلَبَتْ عَمْرَةُ بِنْتُ رَوَاحَةَ إِلَى بَشِيرِ بْنِ سَعْدٍ أَنْ يَنْحِلَنِيَ نَحْلا مِنْ مَالِهِ ، وَإِنَّهُ أَبَى عَلَيْهَا ، ثُمَّ بَدَا لَهُ بَعْدَ حَوْلٍ أَوْ حَوْلَيْنِ أَنْ يَنْحَلَنِيهِ ، فَقَالَ لَهَا : الَّذِي سَأَلْتِ لابْنِي كُنْتُ مَنَعْتُكِ ، وَقَدْ بَدَا لِي أَنْ أَنْحَلَهُ إِيَّاهُ ، قَالَتْ : لا وَاللَّهِ ، لا أَرْضَى حَتَّى تَأْخُذَ بِيَدِهِ فَتَنْطَلِقَ بِهِ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَتُشْهِدَهُ ، قَالَ : فَأَخَذَ بِيَدِي ، فَانْطَلَقَ بِي إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَصَّ عَلَيْهِ الْقِصَّةَ ، فَقَالَ لَهُ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " هَلْ لَكَ مَعَهُ وَلَدٌ غَيْرَهُ ؟ " قَالَ : نَعَمْ ، قَالَ : " فَهَلْ آتَيْتَ كُلَّ وَاحِدٍ مِنْهُمْ مِثْلَ الَّذِي آتَيْتَ هَذَا ؟ " قَالَ : لا ، قَالَ : " فَإِنِّي لا أَشْهَدُ عَلَى هَذَا ، هَذَا جَوْرٌ ، أَشْهِدْ عَلَى هَذَا غَيْرِي ، اعْدِلُوا بَيْنَ أَوْلادِكُمْ فِي النَّحْلِ كَمَا تُحِبُّونَ أَنْ يَعْدِلُوا بَيْنَكُمْ فِي الْبِرِّ ، وَاللُّطْفِ " ، قَالَ أَبُو حَاتِمٍ رَضِيَ اللَّهُ عَنْهُ : قَوْلُهُ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَشْهِدْ عَلَى هَذَا غَيْرِي ، أَرَادَ بِهِ الإِعْلامَ بِنَفْيِ جَوَازِ اسْتِعْمَالِ الْفِعْلِ الْمَأْمُورِ بِهِ لَوْ فَعَلَهُ ، فَزَجَرَ عَنِ الشَّيْءِ بِلَفْظِ الأَمْرِ بِضِدِّهِ ، كَمَا قَالَ لِعَائِشَةَ : اشْتَرِطِي لَهُمُ الْوَلاءَ ، فَإِنَّمَا الْوَلاءُ لِمَنْ أَعْتَقَ .
Sayyiduna Nu’man bin Bashir (may Allah be pleased with him) narrates: (My mother) Amrah bint Rawahah said to (my father) Sayyiduna Bashir bin Sa’d that he should give me (i.e., Sayyiduna Nu’man bin Bashir) a gift from his wealth, but he did not accept the request of that woman. After one or two years passed, he found it appropriate and gave me a gift. He said to that woman: The request you made regarding my son, I did not fulfill it at that time. Now I find it appropriate to give him a gift. That woman said: No, by Allah, I will not be pleased until you take him by the hand and go with him to the Prophet (peace and blessings of Allah be upon him) and make the Prophet (peace and blessings of Allah be upon him) a witness to this matter. Sayyiduna Nu’man bin Bashir (may Allah be pleased with him) narrates: He took me by the hand and went with me to the Prophet (peace and blessings of Allah be upon him) and told him the whole incident. The Prophet (peace and blessings of Allah be upon him) asked him: Do you have any children other than him? He replied: Yes. The Prophet (peace and blessings of Allah be upon him) asked: Have you given each of them the same as you have given him? He replied: No. The Prophet (peace and blessings of Allah be upon him) said: Then I do not become a witness to this, this is injustice. Make someone else a witness besides me. You people should act justly among your children regarding gifts, just as you like them to act justly with you regarding goodness and virtue.
(Imam Ibn Hibban, may Allah have mercy on him, says:) The statement of the Prophet (peace and blessings of Allah be upon him): “Make someone else a witness besides me,” means to inform that if they do this act, then acting upon it will not be permissible. So the Prophet (peace and blessings of Allah be upon him) forbade this matter by using words that command its opposite, just as the Prophet (peace and blessings of Allah be upon him) said to Sayyidah Aisha (may Allah be pleased with her): Leave the condition of wala’ for them, because the right of wala’ belongs to the one who sets free.
