ذكر خبر أوهم غير المتبحر في صناعة العلم أنه مضاد لخبر أبي هريرة الذي ذكرناه-
Report that may mislead those not versed in knowledge into thinking it contradicts Abu Huraira's narration
Hadith 5074
أَخْبَرَنَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ الْجُنَيْدِ ، أَخْبَرَنَا قُتَيْبَةُ بْنُ سَعِيدٍ ، حَدَّثَنَا أَبُو الأَحْوَصِ ، عَنْ سِمَاكٍ ، عَنْ عَلْقَمَةَ بْنِ وَائِلٍ ، عَنْ أَبِيهِ ، قَالَ : جَاءَ رَجُلٌ مِنْ حَضْرَمَوْتَ وَرَجُلٌ مِنْ كِنْدَةَ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ الْحَضْرَمِيُّ : يَا رَسُولَ اللَّهِ ، إِنَّ هَذَا قَدْ غَلَبَنِي عَلَى أَرْضٍ لِي كَانَتْ لأَبِي ، فَقَالَ الكنديُّ : هِيَ أَرْضِي فِي يَدِي زَرَعْتُهَا ، لَيْسَ لَهُ فِيهَا حَقٌّ ، فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لِلْحَضْرَمِيِّ : " أَلَكَ بَيِّنَةٌ ؟ " قَالَ : لا ، قَالَ : " فَلَكَ يَمِينُهُ " ، قَالَ : يَا رَسُولَ اللَّهِ ، إِنَّ الرَّجُلَ فَاجِرٌ ، لا يُبَالِي عَلَى مَا حَلَفَ عَلَيْهِ ، وَلَيْسَ يَتَوَرَّعُ مِنْ شَيْءٍ ، قَالَ : " لَيْسَ لَكَ مِنْهُ إِلا ذَلِكَ " ، قَالَ : فَانْطَلَقَ لِيَحْلِفَ لَهُ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لَمَّا أَدْبَرَ : " أَمَا لَئِنْ حَلَفَ عَلَى مَالِهِ لِيَأْكُلَهُ ظُلْمًا ، لَيَلْقَيَنَّ اللَّهَ جَلَّ وَعَلا وَهُوَ عَنْهُ مُعْرِضٌ " .
Alqamah bin Wa'il narrates from his father: A man from Hadhramaut and a man from Kindah came to the service of the Prophet Muhammad (peace be upon him). The man from Hadhramaut said: O Messenger of Allah, this person has seized my land which belonged to my father. The man from Kindah said: That land is mine. It is in my possession. I have cultivated it. He has no right to that land. The Prophet Muhammad (peace be upon him) asked the man from Hadhramaut: Do you have any proof? He replied: No. The Prophet Muhammad (peace be upon him) said: Then you will have to take an oath. The other man said: He is a sinful person; he does not care on what matter he swears. He fears nothing. The Prophet Muhammad (peace be upon him) said: This is all you can get from him. The narrator states: When that man got ready to take the oath, the Prophet Muhammad (peace be upon him) said, after he left: If this person has sworn about this property in order to seize it unjustly, then when he will appear before Allah Almighty, Allah will turn away from him.
