ذكر الخبر الدال على أن الحاكم له أن يهدد الخصمين بما لا يريد أن يمضيه إذا أراد استكشاف واضح خفي عليه-
Report indicating that a judge may threaten disputants with what he does not intend to enforce to uncover the truth
Hadith 5066
أَخْبَرَنَا الْحَسَنُ بْنُ سُفْيَانَ ، حَدَّثَنَا أُمَيَّةُ بْنُ بِسْطَامٍ ، حَدَّثَنَا يَزِيدُ بْنُ زُرَيْعٍ ، حَدَّثَنَا رَوْحُ بْنُ الْقَاسِمِ ، عَنِ ابْنِ عَجْلانَ ، عَنْ أَبِي الزِّنَادِ ، عَنِ الأَعْرَجِ ، عَنْ أَبِي هُرَيْرَةَ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " إِنَّ امْرَأَتَيْنِ أَتَتَا دَاوُدَ ، وَكُلُّ وَاحِدَةٍ تَخْتَصِمُ فِي ابْنِهَا ، فَقَضَى لِلْكُبْرَى ، فَلَمَّا خَرَجَتَا ، قَالَ سُلَيْمَانُ : كَيْفَ قَضَى بَيْنَكُمَا ؟ فَأَخْبَرَتَاهُ ، فَقَالَ : ائْتُونِي بِالسِّكِّينِ ، وَأَوَّلُ مَنْ سَمِعْتُهُ يَقُولُ السِّكِّينُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، إِنَّمَا كُنَّا نُسَمِّيهَا الْمُدْيَةَ ، فَقَالَتِ الصُّغْرَى : مَهْ ؟ قَالَ : أَشُقُّهُ بَيْنَكُمَا ، قَالَتِ : ادْفَعْهُ إِلَيْهَا ، وَقَالَتِ : الْكُبْرَى شُقَّهُ بَيْنَنَا ، قَالَ : فَقَضَاهُ سُلَيْمَانُ لِلصُّغْرَى ، وَقَالَ : لَوْ كَانَ ابْنَكِ لَمْ تَرْضَيْ أَنْ نَشُقَّهُ " .
Sayyiduna Abu Hurairah (may Allah be pleased with him) narrates that the Prophet (peace and blessings be upon him) said: "Two women came to Sayyiduna Dawud (peace be upon him) disputing over a child. Sayyiduna Dawud (peace be upon him) gave judgment in favor of the older woman. When both of them left, Sayyiduna Sulaiman (peace be upon him) inquired, 'What decision did Sayyiduna Dawud (peace be upon him) give between you two?' Both women informed Sayyiduna Sulaiman (peace be upon him) about it. So Sayyiduna Sulaiman (peace be upon him) said, 'Bring me a knife.' (The narrator says: For the first time, I heard the word 'sikkeen' from the Prophet (peace and blessings be upon him), because we used the word 'madiyah' for a knife.) The younger woman asked, 'Why?' Sayyiduna Sulaiman (peace be upon him) said, 'I will divide this child between you both.' The younger woman said, 'Hand over this child to the older woman,' while the older woman said, 'Divide him between us.' The Prophet (peace and blessings be upon him) said: So Sayyiduna Sulaiman (peace be upon him) gave judgment in favor of the younger woman. He said: 'If this was your son, you would not be pleased that he be cut into pieces.'"
