ذكر الزجر عن دخول المرء في قضاء المسلمين إذا علم تعذر سلوك الحق فيه-

Warning against taking up judgment among Muslims if one knows justice cannot be upheld

Hadith 5056
أَخْبَرَنَا الْحَسَنُ بْنُ سُفْيَانَ ، قَالَ : حَدَّثَنَا أُمَيَّةُ بْنُ بِسْطَامٍ ، قَالَ : حَدَّثَنَا مُعْتَمِرُ بْنُ سُلَيْمَانَ ، قَالَ : سَمِعْتُ عَبْدَ الْمَلِكِ بْنَ أَبِي جَمِيلَةَ يُحَدِّثُ ، عَنْ عَبْدِ اللَّهِ بْنِ وَهْبٍ ، أَنَّ عُثْمَانَ بْنَ عَفَّانَ ، قَالَ لابْنِ عُمَرَ : اذْهَبْ فَكُنْ قَاضِيًا ، قَالَ : أَوَتُعْفِينِي يَا أَمِيرَ الْمُؤْمِنِينَ ؟ قَالَ : اذْهَبْ ، فَاقْضِ بَيْنَ النَّاسِ ، قَالَ : تُعْفِيَنِي يَا أَمِيرَ الْمُؤْمِنِينَ ؟ قَالَ : عَزَمْتُ عَلَيْكَ إِلا ذَهَبْتَ فَقَضَيْتَ ، قَالَ : لا تَعْجَلْ ، سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، يَقُولُ : " مَنْ عَاذَ بِاللَّهِ فَقَدْ عَاذَ مَعَاذًا " ، قَالَ : نَعَمْ ، قَالَ : فَإِنِّي أَعُوذُ بِاللَّهِ أَنْ أَكُونَ قَاضِيًا ، قَالَ : وَمَا يَمْنَعُكَ وَقَدْ كَانَ أَبُوكَ يَقْضِي ؟ قَالَ : لأَنِّي سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، يَقُولُ : " مَنْ كَانَ قَاضِيًا فَقَضَى بِالْجَهْلِ كَانَ مِنْ أَهْلِ النَّارِ ، وَمَنْ كَانَ قَاضِيًا فَقَضَى بِالْجَوْرِ كَانَ مِنْ أَهْلِ النَّارِ ، وَمَنْ كَانَ قَاضِيًا عَالِمًا يَقْضِي بِحَقٍّ أَوْ بِعَدْلٍ ، سَأَلَ التَّفَلُّتَ كَفَافًا " ، فَمَا أَرْجُو مِنْهُ بَعْدَ ذَا ، قَالَ أَبُو حَاتِمِ : ابْنُ وَهْبٍ وهَذَا ، هَذَا هُوَ عَبْدُ اللَّهِ بْنُ وَهْبِ بْنِ الأَسْوَدِ الْقُرَشِيُّ مِنَ الْمَدِينَةِ رَوَى عَنْهُ الزُّهْرِيُّ .
Abdullah bin Wahb narrates: Sayyiduna Uthman Ghani (may Allah be pleased with him) said to Sayyiduna Abdullah bin Umar (may Allah be pleased with them both): "You go, you are the judge." Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) submitted: "O Commander of the Faithful, will you not excuse me from this?" Sayyiduna Uthman (may Allah be pleased with him) said: "You go and judge between the people." He requested: "O Commander of the Faithful, will you not excuse me from this?" Sayyiduna Uthman (may Allah be pleased with him) said: "I am insisting that you go and judge." Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) submitted: "Do not be hasty. I heard the Noble Prophet (peace and blessings of Allah be upon him) say: 'Whoever seeks Allah's protection, he seeks the protection of One whose protection is to be sought.'" Sayyiduna Uthman (may Allah be pleased with him) said: "Alright." Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) said: "Then I seek Allah's protection from becoming a judge." Sayyiduna Uthman (may Allah be pleased with him) asked: "Why do you not do so, while your father used to give judgments?" Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) replied: "I heard the Noble Prophet (peace and blessings of Allah be upon him) say: 'Whoever is a judge and gives a verdict without knowledge will be among the people of Hell, and whoever is a judge and gives a verdict according to oppression will be among the people of Hell, and whoever is a judge, is knowledgeable, and gives a verdict with truth (the narrator is in doubt, perhaps these are the words) and with justice, even he (on the Day of Resurrection) will wish that he had been left alone on equal footing.'" (Sayyiduna Abdullah bin Umar, may Allah be pleased with them both, said:) "So after this, what hope can I have?"

(Imam Ibn Hibban, may Allah have mercy on him, says:) The narrator named Ibn Wahb is Abdullah bin Wahb bin Aswad Qurashi, who was from Madinah Munawwarah. Ibn Shihab Zuhri has narrated traditions from him.
