Chapter: Disaster - Clarification that the seller cannot take any remaining payment for fruit ruined by disaster
Hadith 5033
أَخْبَرَنَا ابْنُ قُتَيْبَةَ ، حَدَّثَنَا يَزِيدُ بْنُ مَوْهَبٍ ، حَدَّثَنَا اللَّيْثُ بْنُ سَعْدٍ ، عَنْ بُكَيْرِ بْنِ عَبْدِ اللَّهِ بْنِ الأَشَجِّ ، عَنْ عِيَاضِ بْنِ عَبْدِ اللَّهِ بْنِ سَعْدٍ ، عَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ ، أَنَّهُ قَالَ : " أُصِيبَ رَجُلٌ فِي عَهْدِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي ثِمَارٍ ابْتَاعَهَا ، فَكَثُرَ دَيْنُهُ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " تَصَدَّقُوا عَلَيْهِ " ، فَتُصُدِّقَ عَلَيْهِ ، فَلَمْ يَبْلُغْ ذَلِكَ وَفَاءَ دَيْنِهِ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " خُذُوا مَا وَجَدْتُمْ ، وَلَيْسَ لَكُمْ إِلا ذَلِكَ " .
Sayyiduna Abu Sa'id Khudri (may Allah be pleased with him) narrates: In the blessed time of the Prophet (peace and blessings of Allah be upon him), a man suffered a loss in the fruits he had purchased and his debt increased. The Prophet (peace and blessings of Allah be upon him) said: "Give charity to him." Charity was given to that man, but still it was not enough to fully pay off his debt. So the Prophet (peace and blessings of Allah be upon him) said (i.e., to the creditors): "Take what is being given to you; you will get only this."
