Chapter: Forbidden sales - Clarification that the permitted "Ariya" sale is exchanging some fresh dates for dried dates
Hadith 5001
أَخْبَرَنَا عُمَرُ بْنُ سَعِيدِ بْنِ سِنَانٍ ، قَالَ : أَخْبَرَنَا أَحْمَدُ بْنُ أَبِي بَكْرٍ ، عَنْ مَالِكٍ ، عَنْ نَافِعٍ ، عَنِ ابْنِ عُمَرَ ، عَنْ زَيْدِ بْنِ ثَابِتٍ ، " أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ رَخَّصَ لِصَاحِبِ الْعَرِيَّةِ أَنْ يَبِيعَهَا بِخَرْصِهَا مِنَ التَّمْرِ " .
Sayyiduna Zaid bin Thabit (may Allah be pleased with him) narrates: The Prophet Muhammad (peace and blessings be upon him) granted concession to the owner of ‘Ariyyah; he can sell dates by estimation.
Hadith 5002
أَخْبَرَنَا حَامِدُ بْنُ مُحَمَّدِ بْنِ شُعَيْبٍ ، قَالَ : حَدَّثَنَا سُرَيْجُ بْنُ يُونُسَ ، قَالَ : حَدَّثَنَا سُفْيَانُ ، عَنْ يَحْيَى بْنِ سَعِيدٍ ، عَنْ بَشِيرِ بْنِ يَسَارٍ ، عَنْ سَهْلِ بْنِ أَبِي حَثْمَةَ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " نَهَى عَنْ بَيْعِ الثَّمَرِ بِالثَّمَرِ ، وَرَخَّصَ فِي الْعَرِيَّةِ أَنْ تُبَاعَ بِخَرْصِهَا ، وَالْعَرِيَّةُ أَنْ يَأْكُلَهَا أَهْلُهَا رُطَبًا " .
Sayyiduna Sahl bin Abi Hathmah (may Allah be pleased with him) narrates: The Prophet (peace and blessings of Allah be upon him) forbade selling fruit in exchange for fruit, except that he permitted ‘Ariyyah, which can be sold by estimation. ‘Ariyyah is: its household eats fresh dates.
