Chapter: Forbidden sales - Description of "Mulamasa" and how "Munabatha" is done
Hadith 4976
أَخْبَرَنَا مُحَمَّدُ بْنُ الْحَسَنِ بْنِ قُتَيْبَةَ بِعَسْقَلانَ ، قَالَ : حَدَّثَنَا ابْنُ أَبِي السَّرِيِّ ، قَالَ : حَدَّثَنَا عَبْدُ الرَّزَّاقِ ، قَالَ : أَخْبَرَنَا مَعْمَرٌ ، عَنِ الزُّهْرِيِّ ، عَنْ عَطَاءِ بْنِ يَزِيدَ اللَّيْثِيِّ ، عَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ ، قَالَ : " نَهَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ بَيْعَتَيْنِ الْمُلامَسَةِ وَالْمُنَابَذَةِ " ، فَالْمُنَابَذَةُ هُوَ أَنْ يَقُولَ : إِذَا نَبَذْتُ إِلَيْكَ هَذَا الثَّوْبَ ، فَقَدْ وَجَبَ الْبَيْعُ ، وَالْمُلامَسَةُ أَنْ يَمَسَّهُ بِيَدِهِ ، وَلا يَنْشُرُهُ ، وَلا يُقَلِّبُهُ ، يَقُولُ : إِذَا مَسَّهُ وَجَبَ الْبَيْعُ ، قَالَ أَبُو حَاتِمٍ رَضِيَ اللَّهُ عَنْهُ : الْمُنَابَذَةُ أَنْ يَنْبِذَ الْمُشْتَرِي ثَوْبًا إِلَى الْبَائِعِ ، وَيَنْبِذَ الْبَائِعُ إِلَى الْمُشْتَرِي ثَوْبًا لِيَبِيعَ أَحَدَهُمَا وَصَلَهُ عَلَى أَنَّهُمَا إِذَا وَقَفَا بَعْدَ ذَلِكَ عَلَى الطُّولِ وَالْعَرْضِ لا يَكُونُ لَهُمَا الْخِيَارُ إِلا ذَلِكَ النَّبْذُ فَقَطْ ، وَالْمُلامَسَةُ أَنْ يَلْمِسَ الْمُشْتَرِي الثَّوْبَ ، ثُمَّ يَشْتَرِيَهُ عَلَى أَنْ لا خِيَارَ بَعْدَ ذَلِكَ إِذَا نَشَرَهُ وَقَلَّبَهُ سِوَى ذَلِكَ اللَّمْسِ .
Sayyiduna Abu Sa'id Khudri (may Allah be pleased with him) narrates: The Prophet (peace and blessings of Allah be upon him) forbade two types of sales: Mulamasah and Munabadhah. (The narrator says:) Munabadhah is when a person says: When I throw this cloth towards you, the deal will be finalized. Mulamasah is when a person touches it with his hand, does not open it, does not turn it over, and says: As soon as I touch it, the deal will become binding. (Imam Ibn Hibban, may Allah have mercy on him, says:) Munabadhah is when the buyer throws the cloth towards the seller and the seller throws the cloth towards the buyer so that the deal between them is finalized. On the condition that when, after that, they become aware of the length and width of the cloth, they will have no right to cancel the deal; only this act of throwing (will be the sign of the deal being finalized). Mulamasah is when the buyer touches the cloth and then buys it on the condition that after that he will have no right (to cancel), meaning when he opens it and when he turns it over (he will have no right); only touching will be sufficient.
