ذكر البيان بأن النخل إذا أبرت والعبد الذي له مال إذا بيعا يكون الثمر والمال للبائع ما لم يتقدم للمبتاع فيه الشرط-
Clarification that if a pollinated palm or a slave with money is sold, the fruit and money belong to the seller unless stipulated otherwise
Hadith 4923
أَخْبَرَنَا الْفَضْلُ بْنُ الْحُبَابِ ، حَدَّثَنَا مُسَدَّدُ بْنُ مُسَرْهَدٍ ، عَنْ سُفْيَانَ ، عَنِ الزُّهْرِيِّ ، عَنْ سَالِمٍ ، عَنْ أَبِيهِ ، يَبْلُغُ بِهِ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " مَنْ بَاعَ نَخِيلا بَعْدَ أَنْ تُؤَبَّرَ فَثَمَرَتُهَا لِلَّذِي بَاعَهَا إِلا أَنْ يَشْتَرِطَ الْمُبْتَاعُ ، وَمَنْ بَاعَ عَبْدًا وَلَهُ مَالٌ فَمَالُهُ لِلَّذِي بَاعَهُ إِلا أَنْ يَشْتَرِطَ الْمُبْتَاعُ " .
Salim narrates from his father (Sayyiduna Abdullah bin Umar, may Allah be pleased with them both): The following statement of the Prophet (peace and blessings be upon him) reached him: "Whoever sells a date-palm tree after it has been pollinated, its fruit will belong to the seller, unless the buyer has stipulated otherwise (then the ruling is different). And whoever sells a slave who possesses property, that property will belong to the seller, unless the buyer has stipulated otherwise (then the ruling will be different)."
