Hadith 4922
أَخْبَرَنَا
ابْنُ قُتَيْبَةَ ، حَدَّثَنَا
يَزِيدُ بْنُ مَوْهَبٍ ، حَدَّثَنِي
اللَّيْثُ ، عَنِ
ابْنِ شِهَابٍ ، عَنْ
سَالِمٍ ، عَنِ
ابْنِ عُمَرَ ، قَالَ : سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، يَقُولُ : " مَنِ ابْتَاعَ نَخْلا بَعْدَ أَنْ تُؤَبَّرَ فَثَمَرَتُهَا لِلَّذِي بَاعَهَا إِلا أَنْ يَشْتَرِطَ الْمُبْتَاعُ ، وَمَنْ بَاعَ عَبْدًا وَلَهُ مَالٌ فَمَالُهُ لِلْبَائِعِ إِلا أَنْ يَشْتَرِطَ الْمُبْتَاعُ " .
Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) narrates: I heard the Prophet Muhammad (peace be upon him) say: "Whoever buys a date-palm orchard after it has been pollinated, its fruit will belong to the one who sold it, unless the buyer has stipulated a condition (then the ruling will be different). And whoever buys a slave who possesses some property, that property will belong to the seller, unless the buyer has stipulated a condition (then the ruling will be different)."
