ذكر البيان بأن مشتري النخلة بعدما أبرت لا يكون له من ثمرها شيء إذا لم يتقدمه الشرط-
Clarification that a buyer of a pollinated palm tree has no right to its fruit unless stipulated
Hadith 4921
أَخْبَرَنَا أَبُو يَعْلَى ، حَدَّثَنَا عَلِيُّ بْنُ الْجَعْدِ ، حَدَّثَنَا ابْنُ أَبِي ذِئْبٍ ، عَنِ ابْنِ شِهَابٍ ، عَنْ سَالِمِ بْنِ عَبْدِ اللَّهِ ، عَنِ ابْنِ عُمَرَ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " مَنِ اشْتَرَى نَخْلا بَعْدَمَا أُبِّرَتْ وَلَمْ يَشْتَرِطْ ثَمَرَهَا فَلا شَيْءَ لَهُ ، وَمَنِ اشْتَرَى عَبْدًا وَلَمْ يَشْتَرِطْ مَالَهُ فَلا شَيْءَ لَهُ " .
Sayyiduna Abdullah bin Umar (may Allah be pleased with them) narrates that the Prophet Muhammad (peace be upon him) said: "Whoever buys a date-palm tree after it has been pollinated, and does not stipulate (at the time of transaction) a condition regarding its fruit, then he will get nothing of it. And whoever buys a slave and does not stipulate a condition regarding the wealth he possesses, then he will get nothing of it."
