Chapter on Spoils of War and Their Distribution – Clarifying that the spoils are not subject to the fifth.
Hadith 4844
أَخْبَرَنَا عُمَرُ بْنُ مُحَمَّدٍ الْهَمْدَانِيُّ ، حَدَّثَنَا عَمْرُو بْنُ عُثْمَانَ ، حَدَّثَنَا الْوَلِيدُ بْنُ مُسْلِمٍ ، عَنْ صَفْوَانَ بْنِ عَمْرٍو ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ جُبَيْرِ بْنِ نُفَيْرٍ ، عَنْ أَبِيهِ ، عَنْ عَوْفِ بْنِ مَالِكٍ ، " أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لَمْ يُخَمِّسِ السَّلَبَ " .
Sayyiduna Awf bin Malik (may Allah be pleased with him) narrates: The Prophet (peace and blessings of Allah be upon him) did not take out a fifth (khums) from the belongings of a killed disbeliever that were given to the killer.
