Chapter on Spoils of War and Their Distribution – On the leader’s duty to distribute the share of relatives from the fifth.
Hadith 4824
أَخْبَرَنَا أَبُو يَعْلَى ، قَالَ : حَدَّثَنَا أَبُو خَيْثَمَةَ ، قَالَ : حَدَّثَنَا عُثْمَانُ بْنُ عُمَرَ ، قَالَ : حَدَّثَنَا يُونُسُ بْنُ يَزِيدَ ، عَنِ الزُّهْرِيِّ ، عَنْ يَزِيدَ بْنِ هُرْمُزَ ، أَنَّ نَجْدَةَ الْحَرُورِيَّ خَرَجَ فِي فِتْنَةِ ابْنِ الزُّبَيْرِ ، أَرْسَلَ إِلَى ابْنِ عَبَّاسٍ يَسْأَلُهُ ، عَنْ سَهْمِ ذَوِي الْقُرْبَى لِمَنْ هُوَ ؟ فَقَالَ : " هُوَ لأَقْرِبَاءِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَسَمَهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لَهُمْ ، وَقَدْ كَانَ عُمَرُ عَرَضَ عَلَيْنَا مِنْهُ عَرْضًا رَأَيْنَاهُ دُونَ حَقِّنَا ، فَرَدَدْنَا عَلَيْهِ وَأَبَيْنَا أَنْ نَقْبَلَهُ ، فَكَانَ عَرَضَ عَلَيْهِمْ أَنْ يُعِينَ نَاكِحَهُمْ ، وَأَنْ يَقْضِيَ عَنْ غَارِمِهِمْ وَأَنْ يُعْطِيَ فَقِيرَهُمْ ، وَأَبَى أَنْ يَزِيدَهُمْ عَلَى ذَلِكَ " .
Yazid bin Hurmaz narrates: During the trial of Abdullah bin Zubair (may Allah be pleased with him), Najdah Haruri sent a message to Abdullah bin Abbas (may Allah be pleased with them both) and asked him: Will the specific share for the near relatives be given? Abdullah (may Allah be pleased with him) replied: This will be given to the relatives of the Prophet (peace be upon him). The Prophet (peace be upon him) used to distribute this share among them. Umar (may Allah be pleased with him) offered us a portion from it, about which we thought that it was less than our right, so we returned it and refused to accept it. He used to offer this share to those relatives by helping the one who wanted to get married, or by paying on behalf of the one who had to pay blood money, or by giving it to a poor person, but they refused to give more than that.
