Chapter on Setting Out and the Manner of Jihad – On the command to kill those who have reached puberty in enemy territory and to overlook those who have not.
Hadith 4781
أَخْبَرَنَا أَبُو يَعْلَى ، حَدَّثَنَا أَبُو خَيْثَمَةَ ، حَدَّثَنَا جَرِيرٌ ، عَنْ عَبْدِ الْمَلِكِ بْنِ عُمَيْرٍ ، عَنْ عَطِيَّةَ الْقُرَظِيِّ ، قَالَ : كُنْتُ فِيمَنْ حَكَمَ فِيهِمْ سَعْدُ بْنُ مُعَاذٍ ، فَشَكَّوْا فِيَّ أَمِنَ الذُّرِّيَّةِ أَنَا أَمْ مِنَ الْمُقَاتِلَةِ ؟ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " انْظُرُوا ، فَإِنْ كَانَ أَنْبَتَ الشَّعْرَ فَاقْتُلُوهُ ، وَإِلا فَلا تَقْتُلُوهُ " .
Atiyyah Qarazi reports: I was among those about whom Sayyiduna Sa’d bin Mu’adh (may Allah be pleased with him) had given a verdict. The people doubted about me whether I was a minor or would be counted among the fighting men. So the Prophet Muhammad (peace and blessings be upon him) said: Examine this—if he has grown pubic hair, then kill him; if not, then do not kill him.
