Chapter on Setting Out and the Manner of Jihad – On the report denying the permissibility of killing a combatant who shows some sign of Islam.
Hadith 4752
أَخْبَرَنَا الْحَسَنُ بْنُ سُفْيَانَ ، قَالَ : حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ ، قَالَ : حَدَّثَنَا عَبْدُ الرَّحِيمِ بْنُ سُلَيْمَانَ ، عَنْ إِسْرَائِيلَ ، عَنْ سِمَاكٍ ، عَنْ عِكْرِمَةَ ، عَنِ ابْنِ عَبَّاسٍ ، قَالَ : " مَرَّ رَجُلٌ مِنْ بَنِي سُلَيْمٍ عَلَى نَفَرٍ مِنْ أَصْحَابِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَمَعَهُ غَنَمٌ ، فَسَلَّمَ عَلَيْهِمْ ، فَقَالُوا : مَا سَلَّمَ عَلَيْكُمْ إِلا لِيَتَعَوَّذَ مِنْكُمْ ، فَعَدَوْا عَلَيْهِ ، فَقَتَلُوهُ وَأَخَذُوا غَنَمَهُ ، فَأَتَوْا بِهَا رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَأَنْزَلَ اللَّهُ : يَأَيُّهَا الَّذِينَ آمَنُوا إِذَا ضَرَبْتُمْ فِي سَبِيلِ اللَّهِ فَتَبَيَّنُوا سورة النساء آية 94 " ، إِلَى آخِرِ الآيَةِ .
Sayyiduna Abdullah bin Abbas (may Allah be pleased with him) narrates: A man from Banu Sulaym passed by some companions of the Prophet (peace and blessings be upon him), and that man had some goats with him. The man greeted them with salam, but those people said: "He only greeted you so that he could be safe from you." They attacked him, killed him, and took his goats. Then they brought those goats to the Prophet (peace and blessings be upon him), so Allah the Exalted revealed this verse: "O you who believe! When you go forth in the way of Allah, investigate carefully..." — and the verse continues to the end.
