Chapter on Punishment for Theft – Denial of cutting for one who takes what is not his by snatching
Hadith 4457
أَخْبَرَنَا مُحَمَّدُ بْنُ عُبَيْدِ اللَّهِ بْنِ الْفَضْلِ الْكَلاعِيُّ الْعَابِدُ بِحِمْصَ ، حَدَّثَنَا مُؤَمَّلُ بْنُ إِِهَابٍ ، حَدَّثَنَا عَبْدُ الرَّزَّاقِ ، عَنِ ابْنِ جُرَيْجٍ ، عَنْ أَبِي الزُّبَيْرِ ، وَعَمْرِو بْنِ دِينَارٍ ، عَنْ جَابِرٍ ، أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " لَيْسَ عَلَى مُنْتَهِبٍ ، وَلا مُخْتَلِسٍ ، وَلا خَائِنٍ قَطْعٌ " .
Sayyiduna Jabir (may Allah be pleased with him) narrates this statement of the Noble Prophet (peace and blessings be upon him): "The one who snatches, the one who seizes by force, and the one who commits treachery will not be given the punishment of cutting (the hand)."
Hadith 4458
أَخْبَرَنَا أَبُو عَرُوبَةَ بِحِرَّانَ ، حَدَّثَنَا مُحَمَّدُ بْنُ بَشَّارٍ ، حَدَّثَنَا مُؤَمَّلُ بْنُ إِِسْمَاعِيلَ ، حَدَّثَنَا سُفْيَانُ ، عَنْ أَبِي الزُّبَيْرِ ، عَنْ جَابِرٍ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " لَيْسَ عَلَى الْمُخْتَلِسِ ، وَلا عَلَى الْخَائِنِ قَطْعٌ " .
