Chapter on Punishment for Drinking – Description of the number of lashes the Prophet (peace be upon him) gave for wine
Hadith 4450
أَخْبَرَنَا أَبُو يَعْلَى ، حَدَّثَنَا أَبُو خَيْثَمَةَ ، قَالَ : حَدَّثَنَا يَزِيدُ بْنُ هَارُونَ ، قَالَ : أَخْبَرَنَا شُعْبَةُ ، عَنْ قَتَادَةَ ، عَنْ أَنَسِ بْنِ مَالِكٍ ، قَالَ : " أَتَى رَجُلٌ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَقَدْ شَرِبَ الْخَمْرَ ، فَأَمَرَ بِهِ فَضُرِبَ بِنَعْلَيْنِ أَرْبَعِينَ " . ثُمَّ أُتِيَ أَبُو بَكْرٍ بِرَجُلٍ قَدْ شَرِبَ الْخَمْرَ فَصَنَعَ بِهِ مِثْلَ ذَلِكَ ، ثُمَّ أُتِيَ عُمَرُ بِرَجُلٍ قَدْ شَرِبَ الْخَمْرَ فَاسْتَشَارَ النَّاسَ فِي ذَلِكَ ، فَقَالَ عَبْدُ الرَّحْمَنِ بْنُ عَوْفٍ : أَخَفَّ الْحُدُودِ ثَمَانِينَ . فَضَرَبَهُ عُمَرُ رِضْوَانُ اللَّهِ عَلَيْهِ ثَمَانِينَ .
Sayyiduna Anas bin Malik (may Allah be pleased with him) narrates: A man came to the service of the Prophet (peace and blessings of Allah be upon him) who had drunk alcohol. By the order of the Prophet (peace and blessings of Allah be upon him), he was given forty lashes with shoes. Then, during the time of Sayyiduna Abu Bakr (may Allah be pleased with him), a man was brought who had drunk alcohol, so Sayyiduna Abu Bakr (may Allah be pleased with him) also gave him the same punishment. Then, during the time of Sayyiduna Umar (may Allah be pleased with him), a man was brought who had drunk alcohol, so Sayyiduna Umar (may Allah be pleased with him) consulted the people about this matter. Sayyiduna Abdur Rahman bin Awf (may Allah be pleased with him) said: The lightest prescribed punishment is eighty lashes. So Sayyiduna Umar (may Allah be pleased with him) had that man given eighty lashes.
