Hadith 4449
أَخْبَرَنَا
الْحَسَنُ بْنُ سُفْيَانَ ، قَالَ : حَدَّثَنَا
مُحَمَّدُ بْنُ الْمِنْهَالِ الضَّرِيرُ ، قَالَ : حَدَّثَنَا
يَزِيدُ بْنُ زُرَيْعٍ ، قَالَ : أَخْبَرَنَا
هِشَامٌ ، عَنْ
قَتَادَةَ ، عَنْ
أَنَسٍ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، وَأَبَا بَكْرٍ " جَلَدَا فِي الْخَمْرِ بِالْجَرِيدِ وَالنِّعَالِ " . فَلَمَّا قَامَ عُمَرُ بْنُ الْخَطَّابِ ، دَنَا النَّاسُ مِنَ الرِّيفِ وَالْقُرَى ، فَاسْتَشَارَ عُمَرُ النَّاسَ فِي جَلْدِ الْخَمْرِ ، فَقَالَ عَبْدُ الرَّحْمَنِ بْنُ عَوْفٍ : يَا أَمِيرَ الْمُؤْمِنِينَ ، مَتَى مَا يَشْرَبْهَا يُهَجَّرْ ، وَمَتَى مَا يُهَجَّرْ يُقْذَفْ ، فَنَرَى أَنْ تَجْعَلَهُ كَأَخَفِّ الْحُدُودِ ، فَكَانَ أَوَّلُ مَنْ جَلَدَ فِي الْخَمْرِ ثَمَانِينَ عُمَرُ رِضْوَانُ اللَّهِ عَلَيْهِ .
Sayyiduna Anas (may Allah be pleased with him) narrates: The Prophet (peace and blessings of Allah be upon him) and Sayyiduna Abu Bakr (may Allah be pleased with him) used to have the punishment for drinking alcohol carried out with date palm branches and shoes. When the caliphate of Sayyiduna Umar ibn Khattab (may Allah be pleased with him) began and people settled in different regions and towns, Sayyiduna Umar (may Allah be pleased with him) consulted the people regarding the punishment for drinking alcohol. Sayyiduna Abdur Rahman ibn Awf (may Allah be pleased with him) said: O Leader of the Believers! When a person drinks alcohol, he will utter obscene words, and when he utters obscene words, he will falsely accuse others of adultery, so we wish that you set its punishment similar to the lowest prescribed limit. (The narrator states) Sayyiduna Umar (may Allah be pleased with him) was the first to prescribe eighty lashes as the punishment for drinking alcohol.
