Chapter on Punishment for Drinking – Description of the punishment for drinking during the Prophet’s time
Hadith 4448
أَخْبَرَنَا الْفَضْلُ بْنُ الْحُبَابِ ، قَالَ : حَدَّثَنَا مُسَدَّدٌ ، عَنْ يَحْيَى ، عَنْ هِشَامٍ ، عَنْ قَتَادَةَ ، عَنْ أَنَسِ بْنِ مَالِكٍ ، أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " جَلَدَ فِي الْحَدِّ بِالْجَرِيدِ وَالنِّعَالِ " . فَلَمَّا كَانَ أَبُو بَكْرٍ رِضْوَانُ اللَّهِ عَلَيْهِ جَلَدَ أَرْبَعِينَ ، فَلَمَّا كَانَ عُمَرُ دَنَا النَّاسُ مِنَ الرِّيفِ وَالْقُرَى فَذُكِرَ لأَصْحَابِهِ ، فَقَالَ عَبْدُ الرَّحْمَنِ : اجْعَلْهَا كَأَخَفِّ الْحُدُودِ .
Sayyiduna Anas bin Malik (may Allah be pleased with him) narrates: The Prophet (peace and blessings of Allah be upon him) had people beaten with date palm branches and shoes as punishment for drinking (alcohol). When the time of Sayyiduna Abu Bakr (may Allah be pleased with him) came, he had forty lashes administered. When the time of Sayyiduna Umar (may Allah be pleased with him) came and people had settled in various towns and regions, this matter was mentioned before his companions. Sayyiduna Abdur Rahman bin Awf (may Allah be pleased with him) said: You should make it like the least of the prescribed punishments (i.e., give punishment accordingly).
