باب حد الشرب - ذكر الأمر بقتل من عاد في شرب الخمر بعد ثلاث مرات فسكر منها-
Chapter on Punishment for Drinking – Instruction to kill one who repeatedly drinks wine and gets drunk after three times
Hadith 4447
أَخْبَرَنَا عَبْدُ اللَّهِ بْنُ مُحَمَّدٍ الأَزْدِيُّ ، قَالَ : حَدَّثَنَا إِِسْحَاقُ بْنُ إِِبْرَاهِيمَ ، قَالَ : أَخْبَرَنَا شَبَابَةُ بْنُ سَوَّارٍ ، قَالَ : حَدَّثَنَا ابْنُ أَبِي ذِئْبٍ ، عَنْ خَالِهِ الْحَارِثِ بْنِ عَبْدِ الرَّحْمَنِ ، عَنْ أَبِي سَلَمَةَ ، عَنْ أَبِي هُرَيْرَةَ ، عَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " إِِذَا سَكِرَ الرَّجُلُ فَاجْلِدُوهُ ، ثُمَّ إِِنْ سَكِرَ فَاجْلِدُوهُ ، ثُمَّ إِِنْ سَكِرَ فَاجْلِدُوهُ ، ثُمَّ إِِنْ سَكِرَ الرَّابِعَةَ فَاضْرِبُوا عُنُقَهُ " . قَالَ أَبُو حَاتِمٍ : مَعْنَاهُ : إِِذَا اسْتَحَلَّ شُرْبَهُ وَلَمْ يَقْبَلْ تَحْرِيمَ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ .
Sayyiduna Abu Hurairah (may Allah be pleased with him) narrates this statement of the Noble Prophet (peace and blessings of Allah be upon him): "When a person becomes intoxicated, flog him. Then if he becomes intoxicated, flog him. Then if he becomes intoxicated, flog him. Then if he becomes intoxicated a fourth time, strike off his neck." (Imam Ibn Hibban, may Allah have mercy on him, says:) Its meaning is: When he considers drinking alcohol to be lawful and does not accept the prohibition prescribed by the Noble Prophet (peace and blessings of Allah be upon him) (then kill him).
