Chapter on Punishment for Drinking
Hadith 4445
أَخْبَرَنَا أَبُو يَعْلَى ، قَالَ : حَدَّثَنَا عُثْمَانُ بْنُ أَبِي شَيْبَةَ ، قَالَ : حَدَّثَنَا أَبُو بَكْرِ بْنُ عَيَّاشٍ ، عَنْ عَاصِمِ بْنِ أَبِي النَّجُودِ ، عَنْ أَبِي صَالِحٍ ، عَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ ، قَالَ : سَمِعْتُ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، يَقُولُ : " مَنْ شَرِبَ الْخَمْرَ فَاجْلِدُوهُ ، وَمَنْ عَادَ فَاجْلِدُوهُ ، فَإِِنْ عَادَ فَاجْلِدُوهُ ، فَإِِنْ عَادَ فَاقْتُلُوهُ " . قَالَ أَبُو حَاتِمٍ رَضِيَ اللَّهُ عَنْهُ : الْعِلَّةُ الْمَعْلُومَةُ فِي هَذَا الْخَبَرِ يُشْبِهُ أَنْ تَكُونَ : فَإِِنْ عَادَ عَلَى أَنْ لا يَقْبَلَ تَحْرِيمَ اللَّهِ ، فَاقْتُلُوهُ .
Sayyiduna Abu Sa'id Khudri (may Allah be pleased with him) narrates: I heard the Prophet (peace and blessings of Allah be upon him) say: "Whoever drinks alcohol, flog him. If he drinks again, flog him again. If he drinks again, then flog him again. If he does it again, then kill him." (Imam Ibn Hibban, may Allah have mercy on him, says:) The specific reason mentioned in this narration could be that if he drinks alcohol again, it would mean that he has not accepted the command of Allah Almighty declaring it forbidden.
