Hadith 4443
أَخْبَرَنَا
عَبْدُ الرَّحْمَنِ بْنُ بَحْرِ بْنِ مُعَاذٍ الْبَزَّارُ ، قَالَ : حَدَّثَنَا
هِشَامُ بْنُ عَمَّارٍ ، قَالَ : حَدَّثَنَا
شُعَيْبُ بْنُ إِِسْحَاقَ ، قَالَ : حَدَّثَنَا
سَعِيدُ بْنُ أَبِي عَرُوبَةَ ، عَنْ
قَتَادَةَ ، عَنِ
الْحَسَنِ ، عَنْ
حِطَّانَ بْنِ عَبْدِ اللَّهِ أَخِي بَنِي رَقَاشٍ ، عَنْ
عُبَادَةَ بْنِ الصَّامِتِ ، قَالَ : كَانَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ إِِذَا أُنْزِلَ عَلَيْهِ كَرْبٌ لِذَلِكَ ، وَتَرَبَّدَ لَهُ وَجْهُهُ ، فَأُنْزِلَ عَلَيْهِ ذَاتَ يَوْمٍ ، فَلَمَّا سُرِّيَ عَنْهُ ، قَالَ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " خُذُوا عَنِّي ، قَدْ جَعَلَ اللَّهُ لَهُنَّ سَبِيلا الثَّيِّبُ بِالثَّيِّبِ ، وَالْبِكْرُ بِالْبِكْرِ ، الثَّيِّبُ بِالثَّيِّبِ جَلْدُ مِائَةٍ ثُمَّ رَجْمٌ بِالْحِجَارَةِ ، وَالْبِكْرُ بِالْبِكْرِ جَلْدُ مِائَةٍ ثُمَّ نَفْيُ سَنَةٍ " . قَالَ أَبُو حَاتِمٍ رَضِيَ اللَّهُ عَنْهُ : هَذَا الْخَبَرُ دَالٌ عَلَى أَنَّ هَذَا الْحُكْمَ كَانَ مِنَ اللَّهِ جَلَّ وَعَلا عَلَى لِسَانِ صَفِيَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي أَوَّلِ مَا أَنْزَلَ حُكْمَ الزَّانِيَيْنِ ، فَلَمَّا رُفِعَ إِِلَيْهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي الزِّنَى وَأَقَرَّ مَاعِزُ بْنُ مَالِكٍ وَغَيْرُهُ بِهَا ، أَمَرَ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِرَجْمِهِمْ وَلَمْ يَجْلِدْهُمْ ، فَذَلِكَ مَا وَصَفْتُ عَلَى أَنَّ هَذَا آخِرُ الأَمْرَيْنِ مِنَ الْمُصْطَفَى صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، وَفِيهِ نَسْخُ الأَمْرِ بِالْجَلْدِ لِلثَّيِّبَيْنِ ، وَالاقْتِصَارُ عَلَى رَجْمِهِمَا .
Sayyiduna Ubadah bin Samit (may Allah be pleased with him) narrates: When revelation would descend upon the Prophet Muhammad (peace and blessings be upon him), it would be difficult for him and his blessed face would change. One day, revelation descended upon him; when this state ended, the Prophet (peace and blessings be upon him) said: Take (the ruling) from me. Allah Almighty has clarified the ruling for them. If a married person commits adultery with another married person, and an unmarried person commits adultery with another unmarried person: In the case of a married person committing adultery with another married person, he will be given one hundred lashes and then stoned to death. And in the case of an unmarried person committing adultery with another unmarried person, he will be given one hundred lashes and exiled for one year. (Imam Ibn Hibban, may Allah have mercy on him, says:) This narration indicates that this ruling is from Allah Almighty, conveyed through His beloved (peace and blessings be upon him), and this is the very first ruling regarding adulterers. That is why, when the case of adultery was presented before the Prophet (peace and blessings be upon him) and Sayyiduna Ma'iz bin Malik (may Allah be pleased with him) confessed to adultery before him, the Prophet (peace and blessings be upon him) ordered him to be stoned to death. He did not have him flogged. Therefore, what I have stated: Two types of rulings have been transmitted from the Prophet (peace and blessings be upon him); the last of them is this, and in it is evidence that the ruling of flogging for the married person has been abrogated, and stoning alone will suffice.
