أَخْبَرَنَا سُلَيْمَانُ بْنُ الْحَسَنِ الْعَطَّارُ بِالْبَصْرَةِ ، قَالَ : حَدَّثَنَا عُبَيْدُ اللَّهِ بْنُ مُعَاذِ بْنِ مُعَاذٍ ، قَالَ : حَدَّثَنَا أَبِي ، قَالَ : حَدَّثَنَا شُعْبَةُ ، عَنْ سِمَاكِ بْنِ حَرْبٍ ، أَنَّهُ سَمِعَ جَابِرَ بْنَ سَمُرَةَ يُحَدِّثُ أَنَّهُ ، شَهِدَ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَأُتِيَ بِرَجُلٍ أَشْعُرَ قَصِيرٍ ذِي عَضَلاتٍ أَقَرَّ بِالزِّنَى ، فَرَدَّهُ مَرَّتَيْنِ ، ثُمَّ أَمَرَ بِهِ فَرُجِمَ . وَقَالَ : " كُلَّمَا نَفَرْنَا غَازِينَ فِي سَبِيلِ اللَّهِ ، يَتَخَلَّفُ أَحَدُكُمْ لَهُ نَبِيبٌ كَنَبِيبِ التَّيْسِ ، يَمْنَحُ إِِحْدَاهُنَّ الْكُثَيْبَةَ ، أَمَا إِِنِّي لَنْ أُوتِيَ بِأَحَدٍ مِنْهُمْ إِِلا جَعَلْتُهُ نَكَالا " . وَرُبَّمَا قَالَ سِمَاكٌ : إِِلا نَكَّلْتُهُ . قَالَ سِمَاكٌ : فَذَكَرْتُهُ لِسَعِيدِ بْنِ جُبَيْرٍ ، فَقَالَ : رَدَّهُ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَرْبَعَ مَرَّاتٍ . قَالَ شُعْبَةُ : وَقَالَ الْحَكَمُ : يَنْبَغِي أَنْ يَرُدَّهُ أَرْبَعَ مَرَّاتٍ . وَقَالَ حَمَّادٌ : مَرَّةً .
Sayyiduna Jabir bin Samurah (may Allah be pleased with him) narrates: He was present with the Prophet (peace and blessings of Allah be upon him) when a man came whose hair was thick, his height was short, and his body was strong. He confessed to committing adultery. He was sent back twice, then, under the command of the Prophet (peace and blessings of Allah be upon him), he was stoned to death. The narrator states: The Prophet (peace and blessings of Allah be upon him) said: "Whenever we go out in the way of Allah for jihad, there is always a person who stays behind and makes sounds like a male animal (i.e., seducing a woman), or gives something and commits adultery with her. Now, whoever such a person is brought to me, I will make him an example for others." The narrator named Simak sometimes narrated a word differently. The narrator named Simak states: I narrated this tradition before Sa'id bin Jubair, and he said: The Prophet (peace and blessings of Allah be upon him) had sent that person back four times. The narrator named Shu'bah states, the narrator named Hakam narrated this, and it is appropriate that such a person be sent back four times. Whereas the narrator named Hammad mentioned that he should be sent back once.
