Chapter on Adultery – Clarification that a virgin adulterer is to be flogged, not stoned
Hadith 4427
أَخْبَرَنَا مُحَمَّدُ بْنُ عَبْدِ الرَّحْمَنِ السَّامِيُّ ، قَالَ : حَدَّثَنَا عَلِيُّ بْنُ الْجَعْدِ ، قَالَ : حَدَّثَنَا شُعْبَةُ ، عَنْ قَتَادَةَ ، عَنِ الْحَسَنِ ، عَنْ حِطَّانَ بْنِ عَبْدِ اللَّهِ ، عَنْ عُبَادَةَ بْنِ الصَّامِتِ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " خُذُوا عَنِّي ، فَقَدْ جَعَلَ اللَّهُ لَهُنَّ سَبِيلا الْبِكْرُ بِالْبِكْرِ ، وَالثَّيِّبُ بِالثَّيِّبِ ، الْبِكْرُ تُجْلَدُ وَتُنْفَى ، وَالثَّيِّبُ تُجْلَدُ وَتُرْجَمُ " .
Sayyiduna Ubadah bin Samit (may Allah be pleased with him) narrates this statement of the Noble Prophet (peace and blessings of Allah be upon him): "Take the rulings from me. Allah Almighty has clarified the command for them. If an unmarried person commits (zina) with an unmarried person, and a married person commits (zina) with a married person, then the unmarried shall be flogged and exiled for one year, and the married shall be flogged and stoned."
