أَخْبَرَنَا الْحُسَيْنُ بْنُ إِِدْرِيسَ الأَنْصَارِيُّ ، قَالَ : أَخْبَرَنَا أَحْمَدُ بْنُ أَبِي بَكْرٍ ، عَنْ مَالِكٍ ، عَنْ يَحْيَى بْنِ سَعِيدٍ ، عَنْ عَمْرَةَ بِنْتِ عَبْدِ الرَّحْمَنِ ، أَنَّ بَرِيرَةَ جَاءَتْ تَسْتَعِينُ عَائِشَةَ ، فَقَالَتْ عَائِشَةُ : إِِنْ أَحَبَّ أَهْلُكِ أَنْ أَصُبَّ لَهُمْ عَنْكِ صَبَّةً ، فَأُعْتِقَكِ فَعَلْتُ ، وَيَكُونُ لِي وَلاؤُكِ ، فَذَكَرَتْ ذَلِكَ بَرِيرَةُ لأَهْلِهَا ، فَقَالُوا لا ، إِِلا أَنْ يَكُونَ الْوَلاءُ لَنَا . قَالَ يَحْيَى : فَزَعَمَتْ عَمْرَةُ أَنَّ عَائِشَةَ ذَكَرَتْ ذَلِكَ لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ : " لا يَمْنَعُكِ ذَلِكَ اشْتَرِيهَا وَأَعْتِقِيهَا ، فَإِِنَّمَا الْوَلاءُ لِمَنْ أَعْتَقَ " . قَالَ أَبُو حَاتِمٍ رَضِيَ اللَّهُ عَنْهُ : فَهَذَا آخِرُ جَوَامِعِ أَنْوَاعِ الأَمْرِ عَنِ الْمُصْطَفَى صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ذَكَرْنَاهَا بِفُصُولِهَا وَأَنْوَاعِ تَقَاسِيمِهَا ، وَقَدْ بَقِيَ مِنَ الأَوَامِرِ أَحَادِيثُ بَدَّدْنَاهَا فِي سَائِرِ الأَقْسَامِ ، لأَنَّ تِلْكَ الْمَوَاضِعَ بِهَا أَشْبَهُ ، كَمَا بَدَّدْنَا مِنْهَا فِي الأَوَامِرِ لِلْبُغْيَةِ فِي الْقَصْدِ فِيهَا ، وَإِِنَّمَا نُمْلِي بَعْدَ هَذَا الْقِسْمَ الثَّانِي الَّذِي هِيَ النَّوَاهِي بِتَفْصِيلِهَا وَتَقْسِيمِهَا عَلَى حَسَبِ مَا أَمْلَيْنَا الأَوَامِرَ إِِنْ قَضَى اللَّهُ ذَلِكَ وَشَاءَهُ ، جَعَلَنَا اللَّهُ مِمَّنْ أَغْضَى فِي الْحُكْمِ فِي دِينِ اللَّهِ عَنْ أَهْوَاءِ الْمُتَكَلِّفِينَ ، وَلَمْ يُعَرِّجْ فِي النَّوَازِلِ عَلَى آرَاءِ الْمُقَلِّدِينَ مِنَ الأَهْوَاءِ الْمَعْكُوسَةِ وَالآرَاءِ الْمَنْحُوسَةِ ، إِِنَّهُ خَيْرُ مَسْئُولٍ .
Umrah bint Abdur Rahman narrates: Barirah came to seek help from Lady Aisha (may Allah be pleased with her). Lady Aisha (may Allah be pleased with her) said: If your owners wish, I will pay them all at once and then I will set you free, and the right of wala’ (allegiance) will belong to me. Barirah mentioned this to her owners, but they said: No, the right of wala’ will remain with us. The narrator named Yahya has reported this, and the woman named Umrah has narrated: Lady Aisha (may Allah be pleased with her) mentioned this to the Prophet Muhammad (peace be upon him), so the Prophet (peace be upon him) said: This should not prevent you; buy her and set her free, for the right of wala’ belongs to the one who sets free. (Imam Ibn Hibban, may Allah have mercy on him, says:) This is the last part of the collection of various types of commands transmitted from the Prophet Muhammad (peace be upon him). We have mentioned these commands under chapters and sub-divisions. Now, some hadiths from the commands remain, which we have transmitted in various places among other types, because they are more suitable for those places, just as we have transmitted some of these hadiths under the commands as well, so that the purpose regarding this may be achieved. After this, we will dictate the second type, which relates to prohibitions. We will mention it under various chapters and sub-divisions, just as we dictated the commands, if Allah Almighty so decides and wills. May Allah Almighty include us among those who, when stating rulings about Allah’s religion, remain detached from the desires of those who are excessive, and do not follow the opinions of those who pursue perverse desires and evil views in new issues. Indeed, He (that is, Allah Almighty) is the best to be asked.
