Chapter on Emancipating a Partner’s Share – Permissibility for the slave to earn to free the remaining share
Hadith 4318
أَخْبَرَنَا الْفَضْلُ بْنُ الْحُبَابِ بِخَبَرٍ غَرِيبٍ ، حَدَّثَنَا إِِبْرَاهِيمُ بْنُ بَشَّارٍ الرَّمَادِيُّ ، حَدَّثَنَا سُفْيَانُ بْنُ عُيَيْنَةَ ، عَنْ سَعِيدِ بْنِ أَبِي عَرُوبَةَ ، وَيَحْيَى بْنُ صُبَيْحٍ ، عَنْ قَتَادَةَ ، عَنِ النَّضْرِ بْنِ أَنَسٍ ، عَنْ بَشِيرِ بْنِ نَهِيكٍ ، عَنْ أَبِي هُرَيْرَةَ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " أَيُّمَا عَبْدٌ كَانَ بَيْنَ اثْنَيْنِ فَأَعْتَقَ أَحَدُهُمَا نَصِيبَهُ ، فَإِِنْ كَانَ مُوسِرًا قُوِّمَ عَلَيْهِ ، وَإِِنْ كَانَ مُعْسِرًا اسْتُسْعِيَ الْعَبْدُ غَيْرَ مَشْقُوقٍ عَلَيْهِ " .
Sayyiduna Abu Hurairah (may Allah be pleased with him) narrates this statement of the Noble Prophet (peace and blessings of Allah be upon him): "Any slave who is jointly owned between two men, and one of them frees his share, then if he (the one who freed) is well-off, he will pay the price of the slave. And if he is poor, then the slave will be made to work without hardship until the price of the other person's share is paid."
