Chapter on Emancipating a Partner’s Share – Ruling on one who frees his share in a jointly owned slave
Hadith 4315
أَخْبَرَنَا أَبُو خَلِيفَةَ ، حَدَّثَنَا أَبُو الْوَلِيدِ الطَّيَالِسِيُّ ، حَدَّثَنَا لَيْثُ بْنُ سَعْدٍ ، عَنْ نَافِعٍ ، عَنِ ابْنِ عُمَرَ ، قَالَ : سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، يَقُولُ : " أَيُّمَا مَمْلُوكٍ كَانَ بَيْنَ شُرَكَاءَ ، فَأَعْتَقَ أَحَدُهُمْ نَصِيبَهُ ، فَإِِنَّهُ يُقَوَّمُ فِي مَالِ الَّذِي أَعْتَقَ قِيمَةَ عَدْلٍ ، فَيُعْتَقُ إِِنْ بَلَغَ ذَلِكَ مَالُهُ " .
Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) narrates: I heard the Prophet Muhammad (peace and blessings be upon him) say: "Any slave who is jointly owned by people, and one of them frees his share, then a fair price for the slave will be set from the wealth of the one who freed his share, and then the slave will be completely freed if the one who freed (his share) possesses enough wealth (equal to the price of the slave)."
