ذكر البيان بأن الأمة المزوجة إذا أعتقت كان لها الخيار في الكون تحت زوجها العبد أو فراقه-
Clarifying that a slave woman married to a slave has the option to stay or leave if freed
Hadith 4269
أَخْبَرَنَا مُحَمَّدُ بْنُ إِِسْحَاقَ بْنِ إِِبْرَاهِيمَ مَوْلَى ثَقِيفٍ ، قَالَ : حَدَّثَنَا هَنَّادُ بْنُ السَّرِيِّ ، وَيَحْيَى بْنُ طَلْحَةَ الْيَرْبُوعِيُّ ، قَالا : حَدَّثَنَا أَبُو مُعَاوِيَةَ ، عَنْ هِشَامِ بْنِ عُرْوَةَ ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْقَاسِمِ ، عَنْ أَبِيهِ ، عَنْ عَائِشَةَ ، قَالَتْ : كَانَ فِي بَرِيرَةَ ثَلاثُ قَضِيَّاتٍ أَرَادَ أَهْلُهَا أَنْ يَبِيعُوهَا وَيَشْتَرِطُوا الْوَلاءَ ، فذكرت ذلك للنبي صلى الله عليه وسلم ، فقال : " اشتريها وأعتقيها ، فَإِِنَّمَا الْوَلاءُ لِمَنْ أَعْتَقَ " . وَعَتَقَتْ ، فَخَيَّرَهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَاخْتَارَتْ نَفْسَهَا ، وَكَانَتْ يُتَصَدَّقُ عَلَيْهَا فَتُهْدِي لَنَا مِنْهُ ، فَذَكَرْتُ ذَلِكَ لِلنَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ : " كُلُوا فَإِِنَّهُ عَلَيْهَا صَدَقَةٌ ، وَهُوَ لَكُمْ هَدِيَّةٌ " .
Lady Aisha Siddiqa (may Allah be pleased with her) narrates: Three rulings were given regarding the matter of Barirah. Her owners intended to sell her and set the condition of her wala (right of inheritance). I mentioned this to the Prophet Muhammad (peace be upon him), and he said: Buy her and set her free, for the right of wala belongs to the one who sets free. Then Barirah was set free. Then the Prophet Muhammad (peace be upon him), as the Imam, gave her the choice (to separate from her husband), so she chose herself (i.e., chose separation). (The third matter is) If anything was given to Barirah as charity, she would give us something from it as a gift. I mentioned this to the Prophet Muhammad (peace be upon him), and he said: You may eat it, for it is charity for her and a gift for you.
