Chapter: Maintenance – The reason the Prophet (peace be upon him) ordered Fatimah bint Qays to observe her waiting period in Ibn Umm Maktum’s house
Hadith 4253
أَخْبَرَنَا عَبْدُ اللَّهِ بْنُ مُحَمَّدِ بْنِ سَلْمٍ ، قَالَ : حَدَّثَنَا عَبْدُ الرَّحْمَنِ بْنُ إِِبْرَاهِيمَ ، قَالَ : حَدَّثَنَا الْوَلِيدُ بْنُ مُسْلِمٍ ، قَالَ : حَدَّثَنَا الأَوْزَاعِيُّ ، قَالَ : حَدَّثَنِي يَحْيَى ، عَنْ أَبِي سَلَمَةَ ، قَالَ : حَدَّثَتْنِي فَاطِمَةُ بِنْتُ قَيْسٍ ، أَنَّ أَبَا عَمْرِو بْنَ حَفْصٍ طَلَّقَهَا ثَلاثًا وَأَمَرَ لَهَا بِنَفَقَةٍ وَاسْتَقَلَّتْهَا ، وَكَانَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بَعَثَهُ نَحْوَ الْيَمَنِ ، فَانْطَلَقَ خَالِدُ بْنُ الْوَلِيدِ فِي نَفَرٍ مِنْ بَنِي مَخْزُومٍ إِِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَهُوَ فِي بَيْتِ مَيْمُونَةَ ، فَقَالَ : يَا رَسُولَ اللَّهِ ، إِِنَّ أَبَا عَمْرِو بْنَ حَفْصٍ طَلَّقَ فَاطِمَةَ ثَلاثًا ، فَهَلْ لَهَا نَفَقَةٌ ؟ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " لَيْسَ لَهَا نَفَقَةٌ وَلا سُكْنَى " . فَأَرْسَلَ إِِلَيْهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنْ تَنْتَقِلَ إِِلَى أُمِّ شَرِيكٍ ، ثُمَّ أَرْسَلَ إِِلَيْهَا : " أَنَّ أُمَّ شَرِيكٍ يَأْتِيهَا الْمُهَاجِرُونَ الأَوَّلُونَ ، فَانْتَقِلِي إِِلَى بَيْتِ ابْنِ أُمِّ مَكْتُومٍ ، فَإِِنَّكِ إِِنْ وَضَعْتِ خِمَارَكِ لَمْ يَرَكِ " ، وَأَرْسَلَ إِِلَيْهَا لا تَسْبِقِينِي بِنَفْسِكِ ، فَزَوَّجَهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِنْ أُسَامَةَ بْنِ زَيْدٍ .
Lady Fatimah bint Qais (may Allah be pleased with her) narrates: Sayyiduna Abu Amr bin Hafs (may Allah be pleased with him) gave her three divorces and instructed her to be given maintenance, but she considered that maintenance to be little. The Prophet (peace and blessings of Allah be upon him) had sent that man towards Yemen. Sayyiduna Khalid bin Walid (may Allah be pleased with him) along with some people from Banu Makhzum came to the service of the Prophet (peace and blessings of Allah be upon him). The Prophet (peace and blessings of Allah be upon him) was at that time in the house of Lady Maymunah. They said: Abu Amr bin Hafs has given Fatimah three divorces, has he? Will she get maintenance? The Prophet (peace and blessings of Allah be upon him) said: She will not get maintenance or accommodation. Then the Prophet (peace and blessings of Allah be upon him) sent a message to that woman that she should move to the house of Lady Umm Sharik (may Allah be pleased with her). Then he sent her a message that the earliest emigrants come and go at Umm Sharik’s house, so you move to the house of Ibn Umm Maktum, because if you remove your garment there, he will not be able to see you. The Prophet (peace and blessings of Allah be upon him) sent her a message: Do not get ahead of me regarding yourself (i.e., after your waiting period is over, consult me before marrying). So the Prophet (peace and blessings of Allah be upon him) married her to Sayyiduna Usamah bin Zaid (may Allah be pleased with him).
