Chapter: Maintenance – Refuting those who obligate housing for a thrice-divorced woman and deny maintenance
Hadith 4252
أَخْبَرَنَا أَبُو يَعْلَى ، قَالَ : حَدَّثَنَا أَبُو خَيْثَمَةَ ، قَالَ : حَدَّثَنَا هُشَيْمٌ ، قَالَ : أَخْبَرَنَا سَيَّارٌ وَحُصَيْنٌ ، وَمُغِيرَةُ ، وَمُجَالِدٌ ، وَإِِسْمَاعِيلُ بْنُ أَبِي خالد ، وداود ، كلهم عَنِ الشَّعْبِيِّ ، قَالَ : دَخَلْتُ عَلَى فَاطِمَةَ بِنْتِ قَيْسٍ فَسَأَلْتُهَا عَنْ قَضَاءِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَتْ : طَلَّقَهَا زَوْجُهَا أَلْبَتَّةَ ، قَالَتْ : فَخَاصَمْتُ إِِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي السُّكْنَى وَالنَّفَقَةِ ، فَلَمْ يَجْعَلْ لِي سُكْنَى وَلا نَفَقَةَ . وَأَمَرَنِي أَنْ أَعْتَدَّ فِي بَيْتِ ابْنِ أُمِّ مَكْتُومٍ " .
Imam Sha’bi narrates: I went to Lady Fatimah bint Qais (may Allah be pleased with her) and I asked her about the decision of the Prophet. She informed me: Her husband had given her a final (irrevocable) divorce. She (the lady) narrates: Regarding residence and maintenance, I presented my case before the Prophet Muhammad (peace be upon him), so the Prophet (peace be upon him) did not grant me the right to residence and maintenance, and he (peace be upon him) instructed me to spend my waiting period (‘iddah) at the house of Ibn Umm Maktum.
