Chapter: Maintenance – No obligation for housing or maintenance for a thrice-divorced woman
Hadith 4250
أَخْبَرَنَا أَبُو خَلِيفَةَ ، قَالَ : حَدَّثَنَا مُحَمَّدُ بْنُ كَثِيرٍ الْعَبْدِيُّ ، قَالَ : أَخْبَرَنَا سُفْيَانُ الثَّوْرِيُّ ، عَنْ سَلَمَةَ بْنِ كُهَيْلٍ ، عَنِ الشَّعْبِيِّ ، عَنْ فَاطِمَةَ بِنْتِ قَيْسٍ ، " أَنَّ زَوْجَهَا طَلَّقَهَا ثَلاثًا ، فَلَمْ يَجْعَلْ لَهَا النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَفَقَةً وَلا سُكْنَى " . قَالَ : فَذَكَرْتُ ذَلِكَ لإِِبْرَاهِيمَ النَّخَعِيَّ ، فَقَالَ : قَالَ عُمَرُ بْنُ الْخَطَّابِ : لا نَدَعُ كِتَابَ رَبِّنَا وَلا سُنةَ نَبِيِّهِ لِقَوْلِ امْرَأَةٍ ، لَهَا النَّفَقَةُ وَالسُّكْنَى .
Sayyidah Fatimah bint Qays (may Allah be pleased with her) narrates: Her husband gave her three divorces, so the Prophet (peace and blessings of Allah be upon him) did not grant her the right to maintenance and residence. The narrator says: I mentioned this narration to Ibrahim Nakha’i, so he informed me: Sayyiduna Umar ibn Khattab (may Allah be pleased with him) used to say, “We will not abandon the Book of our Lord and the Sunnah of our Prophet (peace and blessings of Allah be upon him) because of the statement of a woman; such a woman will receive maintenance and residence.”
