Chapter: Prohibited marriages – A third narration refuting the interpretation of this narration
Hadith 4126
أَخْبَرَنَا الْحَسَنُ بْنُ سُفْيَانَ ، قَالَ : حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ ، قَالَ : حَدَّثَنَا سُفْيَانُ بْنُ عُيَيْنَةَ ، عَنْ أَيُّوبَ بْنِ مُوسَى ، عَنْ نُبَيْهِ بْنِ وَهْبٍ ، أَنَّ عُمَرَ بْنَ عُبَيْدِ اللَّهِ بْنِ مَعْمَرٍ أَرَادَ أَنْ يَنْكِحَ وَهُوَ مُحْرِمٌ ، فَأَرْسَلَ إِلَى أَبَانَ بْنِ عُثْمَانَ ، فَقَالَ أَبَانُ : إِنَّ عُثْمَانَ حَدَّثَ ، أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ : " الْمُحْرِمُ لا يَنْكِحُ ، وَلا يَخْطُبُ ، وَلا يُنْكِحُ " ، قَالَ أَبُو حَاتِمٍ رَضِيَ اللَّهُ عَنْهُ : سَمِعَ هَذَا الْخَبَرَ أَيُّوبُ بْنُ مُوسَى ، عَنْ نُبَيْهِ بْنِ وَهْبٍ نَفْسِهِ ، وَسَمِعَهُ أَيُّوبُ السَّخْتِيَانِيُّ ، عَنْ نَافِعٍ ، عَنْ نُبَيْهِ بْنِ وَهْبٍ ، فَالطَّرِيقَانِ جَمِيعًا مَحْفُوظَانِ .
It is narrated about Umar bin Ubaidullah that he intended to marry during the state of Ihram. He sent a message to Aban bin Uthman, so Aban said: Sayyiduna Uthman Ghani (may Allah be pleased with him) has narrated that the Prophet Muhammad (peace and blessings be upon him) said: "A person in Ihram cannot marry, he cannot send a marriage proposal, and he cannot arrange a marriage for someone else." (Imam Ibn Hibban, may Allah have mercy on him, says:) This narration has been heard directly by Ayyub bin Musa from Nabih bin Wahb, and he has heard this narration from Ayyub Sakhtiyani from Nafi' from Nabih bin Wahb, so both of its chains are preserved.
