Chapter: Prohibited marriages – Forbidding proposing to women while in ihram
Hadith 4123
أَخْبَرَنَا عُمَرُ بْنُ سَعِيدِ بْنِ سِنَانٍ ، قَالَ : أَخْبَرَنَا أَحْمَدُ بْنُ أَبِي بَكْرٍ ، عَنْ مَالِكٍ ، عَنْ نَافِعٍ مَوْلَى ابْنِ عُمَرَ ، عَنْ نُبَيْهِ بْنِ وَهْبٍ أَحَدِ بَنِي عَبْدِ الدَّارِ أَنَّهُ أَخْبَرَهُ ، عَنْ عُمَرَ بْنِ عُبَيْدِ اللَّهِ ، أَرْسَلَ إِلَى أَبَانَ بْنِ عُثْمَانَ ، وَأَبَانُ يَوْمَئِذٍ أَمِيرُ الْحَاجِّ ، وَهُمَا مُحْرِمَانِ : إِنِّي أَرَدْتُ أَنْ أُنْكِحَ طَلْحَةَ بْنَ عُمَرَ ابْنَةَ شَيْبَةَ بْنِ جُبَيْرٍ ، فَأَرَدْتُ أَنْ تَحْضُرَ ذَلِكَ ، فَأَنْكَرَ ذَلِكَ عَلَيْهِ أَبَانُ بْنُ عُثْمَانَ ، وَقَالَ : سَمِعْتُ عُثْمَانَ بْنَ عَفَّانَ ، يَقُولُ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " لا يَنْكِحُ الْمُحْرِمُ ، وَلا يَخْطُبُ ، وَلا يُنْكِحُ " .
It is narrated about Umar bin Ubaidullah: He sent a message to Aban bin Uthman. At that time, Aban was the Amir of Hajj. Both of them were in the state of Ihram. (The message was:) I am about to perform the marriage of Talha bin Umar with the daughter of Shaibah bin Jubair. I wish that you also be present on this occasion. But Aban bin Uthman refused his request and stated: I heard Sayyiduna Uthman Ghani (may Allah be pleased with him) narrate that the Messenger of Allah (peace and blessings be upon him) said: "A person in the state of Ihram cannot marry, cannot give a marriage proposal, and cannot perform the marriage of someone else."
