أَخْبَرَنَا
الْحَسَنُ بْنُ سُفْيَانَ ، قَالَ : حَدَّثَنَا
عَبْدُ الرَّحْمَنِ بْنُ صَالِحٍ الأَزْدِيُّ ، قَالَ : حَدَّثَنَا
ابْنُ أَبِي زَائِدَةَ ، عَنْ
يَحْيَى بْنِ سَعِيدٍ الأَنْصَارِيِّ ، عَنِ
الْقَاسِمِ بْنِ مُحَمَّدٍ ، عَنْ
عَائِشَةَ ، قَالَتْ : سُئِلَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ رَجُلٍ طَلَّقَ امْرَأَتَهُ الْبَتَّةَ ، فَتَزَوَّجَتْ زَوْجًا ، فَطَلَّقَهَا قَبْلَ أَنْ يَدْخُلَ بِهَا ، أَتَرْجِعُ إِلَى زَوْجِهَا الأَوَّلِ ؟ ، قَالَ : " لا حَتَّى يَذُوقَ عُسَيْلَتَهَا مَا ذَاقَ صَاحِبُهَا " ، قَالَ أَبُو حَاتِمٍ : عُمُومُ الْخَطَّابِ فِي الْكِتَابِ فَإِنْ طَلَّقَهَا فَلا تَحِلُّ لَهُ مِنْ بَعْدُ حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ سورة البقرة آية 230 ، وَأَبَاحَ اللَّهُ جَلَّ وَعَلا لِلزَّوْجِ الأَوَّلِ أَنْ يَتَزَوَّجَ بِهَا بَعْدَ أَنْ تَزَوَّجَهَا زَوْجٌ آخَرَ ، وَفَسَّرَتْهُ السُّنَّةُ : أَنَّهَا لا تَحِلُّ لِلزَّوْجِ الأَوَّلِ حَتَّى يَكُونَ بَيْنَهَا وَبَيْنَ الزَّوْجِ الثَّانِي وَطْءٌ بِذَوَاقِ الْعُسَيْلَةِ ، ثُمَّ تَبِينُ عَنْهُ بِطَلاقٍ ، أَوْ وَفَاةٍ ، ثُمَّ تَحِلُّ حِينَئِذٍ لِلزَّوْجِ الأَوَّلِ .
Lady Aisha Siddiqa (may Allah be pleased with her) narrates: It was asked from the Prophet Muhammad (peace be upon him) about a person who gives his wife an irrevocable divorce, then that woman marries another man, and before the second man has intercourse with her, he divorces her. Can that woman return to her first husband? The Prophet Muhammad (peace be upon him) said: No, not until (the second husband) tastes her honey as the first husband tasted. (Imam Ibn Hibban, may Allah have mercy on him, says:) In the Book of Allah, this ruling is mentioned in general terms: "If the man divorces her, she is not lawful for him thereafter until she marries another husband." So Allah Almighty has permitted for the first husband that he may marry her when she marries another man, but the Sunnah has clarified that such a woman is not lawful for the first husband until there is intercourse between the woman and the second husband, which is the tasting of honey, and then after that, if she is separated from him due to divorce or the husband's death, then at that time she will be lawful for the first husband.

عَبْدُ اللَّهِ بْنُ قَحْطَبَةَ ، قَالَ : حَدَّثَنَا
مُحَمَّدُ بْنُ الصَّبَّاحِ ، قَالَ : حَدَّثَنَا
عَبْدُ اللَّهِ بْنُ رَجَاءٍ ، عَنْ
عُبَيْدِ اللَّهِ بْنِ عُمَرَ ، عَنِ
الْقَاسِمِ بْنِ مُحَمَّدٍ ، عَنْ
عَائِشَةَ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فِي رَجُلٍ طَلَّقَ امْرَأَتَهُ ثَلاثًا ، ثُمَّ تَزَوَّجَتْ زَوْجًا غَيْرَهُ ، فَطَلَّقَهَا قَبْلَ أَنْ يَدْخُلَ بِهَا ، ثُمَّ أَرَادَ الأَوَّلُ أَنْ يَتَزَوَّجَهَا ؟ ، قَالَ : " لا حَتَّى يَذُوقَ الآخَرُ عُسَيْلَتَهَا ، وَتَذُوقَ عُسَيْلَتَهُ " ، قَالَ أَبُو حَاتِمٍ : قَالَ اللَّهُ جَلَّ وَعَلا فَإِنْ طَلَّقَهَا فَلا تَحِلُّ لَهُ مِنْ بَعْدُ حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ سورة البقرة آية 230 فَأَبَاحَ اللَّهُ لَهَا أَنْ تَنْكِحَ الزَّوْجَ الأَوَّلَ بَعْدَ أَنْ نَكَحَهَا الزَّوْجُ الثَّانِي ، وَأَبَانَ الْمُصْطَفَى صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مُرَادَ اللَّهِ جَلَّ وَعَلا مِنْ قَوْلِهِ حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ سورة البقرة آية 230 إِذْ هُوَ الْمُبَيُّنُ لِمَجْمَلِ الْخَطَّابِ فِي الْكِتَابِ ، إِذِ الْمُرَادُ مِنْ قَوْلِهِ : حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ سورة البقرة آية 230 الْوَطْءُ دُونَ عُقْدَةِ النِّكَاحِ .
Sayyidah Aisha Siddiqa (may Allah be pleased with her) narrates: The Prophet Muhammad (peace and blessings be upon him) said regarding a person who gives his wife three divorces, then that woman marries another man, and the second man divorces her before consummating the marriage, and the first husband intends to remarry her, about this the Prophet Muhammad (peace and blessings be upon him) said: No, not until the second husband tastes her honey and she tastes his honey (it is not permissible until then). (Imam Ibn Hibban, may Allah have mercy on him, says:) Allah Almighty has said: "If the man divorces her, she is not lawful for him thereafter until she marries another husband." So here Allah Almighty has made it permissible for the woman that she can marry the first husband only after she has married another husband, but the Noble Mustafa (peace and blessings be upon him) has explained the intent of Allah Almighty (the command of Allah Almighty is): "Until she marries another man besides him." So the explanation of the general statement in the Book will be that Allah Almighty's command, "until she marries another man besides the first husband," does not mean merely the contract of marriage, but rather consummation of marriage.
