Chapter: The dowry – Ruling for a widow whose dowry was not set and marriage not consummated
Hadith 4098
أَخْبَرَنَا مُحَمَّدُ بْنُ إِسْحَاقَ بْنِ خُزَيْمَةَ ، قَالَ : حَدَّثَنَا مُحَمَّدُ بْنُ الْمُثَنَّى ، قَالَ : حَدَّثَنَا عَبْدُ الرَّحْمَنِ بْنُ مَهْدِيِّ ، عَنْ سُفْيَانَ ، عَنْ فِرَاسٍ ، عَنِ الشَّعْبِيِّ ، عَنْ مَسْرُوقٍ ، عَنْ عَبْدِ اللَّهِ فِي رَجُلٍ تَزَوَّجَ وَلَمْ يَدْخُلْ بِهَا وَلَمْ يَفْرِضْ ، فَقَالَ : لَهَا الصَّدَاقُ كَامِلا ، وَعَلَيْهَا الْعِدَّةُ ، وَلَهَا الْمِيرَاثُ ، قَالَ مَعْقِلُ بْنُ سِنَانٍ : " شَهِدْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَضَى بِهِ فِي بِرْوَعَ بِنْتِ وَاشِقٍ " .
Masruq reports: Sayyiduna Abdullah (may Allah be pleased with him) was asked about a man who married a woman but did not consummate the marriage with her, nor did he fix a dowry for her. Sayyiduna Abdullah ibn Mas'ud (may Allah be pleased with him) said: Such a woman is entitled to the full dowry, she must observe the waiting period ('iddah), and she is entitled to a share in inheritance. Upon this, Sayyiduna Ma'qil ibn Sinan (may Allah be pleased with him) said: I bear witness regarding the Prophet (peace and blessings be upon him) that he gave the same verdict concerning Barwa' bint Washiq.
Hadith 4099
أَخْبَرَنَا مُحَمَّدُ بْنُ إِسْحَاقَ بْنِ خُزَيْمَةَ فِي عَقِبِهِ ، قَالَ : حَدَّثَنَا مُحَمَّدُ بْنُ بَشَّارٍ ، قَالَ : حَدَّثَنَا عَبْدُ الرَّحْمَنِ ، قَالَ : حَدَّثَنَا سُفْيَانُ ، عَنْ مَنْصُورٍ ، عَنْ إِبْرَاهِيمَ ، عَنْ عَلْقَمَةَ ، عَنْ عَبْدِ اللَّهِ ، بِمِثْلِهِ .
This same narration is also transmitted with another chain of narration from Sayyiduna Abdullah (may Allah be pleased with him).
