Chapter: The guardian – Another narration confirming what we mentioned
Hadith 4088
أَخْبَرَنَا أَبُو يَعْلَى ، حَدَّثَنَا هَارُونُ بْنُ مَعْرُوفٍ ، حَدَّثَنَا سُفْيَانُ ، عَنْ زِيَادِ بْنِ سَعْدٍ ، عَنْ عَبْدِ اللَّهِ بْنِ الْفَضْلِ ، عَنْ نَافِعِ بْنِ جُبَيْرٍ ، عَنِ ابْنِ عَبَّاسٍ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " الثَّيِّبُ أَحَقُّ بِنَفْسِهَا مِنْ وَلِيِّهَا ، وَالْبِكْرُ يَسْتَأْمِرُهَا أَبُوهَا فِي نَفْسِهَا ، وَإِذْنُهَا صُمَاتُهَا " .
Sayyiduna Abdullah bin Abbas (may Allah be pleased with them) narrates: The Prophet Muhammad (peace and blessings be upon him) said: "A previously married woman has more right over herself than her guardian, and regarding a virgin girl, her father will seek her consent about herself, and her permission is her silence."
