Chapter: The guardian – Clarifying that a previously married woman has more right over herself than her guardian when giving consent
Hadith 4084
أَخْبَرَنَا أَبُو خَلِيفَةَ ، حَدَّثَنَا الْقَعْنَبِيُّ عَنْ مَالِكٍ ، عَنْ عَبْدِ اللَّهِ بْنِ الْفَضْلِ ، عَنْ نَافِعِ بْنِ جُبَيْرٍ ، عَنِ ابْنِ عَبَّاسٍ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " الأَيِّمُ أَحَقُّ بِنَفْسِهَا مِنْ وَلِيِّهَا ، وَالْبِكْرُ تُسْتَأْذَنُ ، وَإِذْنُهَا صُمَاتُهَا " .
Sayyiduna Abdullah bin Abbas (may Allah be pleased with them) narrates: The Prophet Muhammad (peace and blessings be upon him) said: "A previously married woman (i.e., widow or divorcee) has more right over herself than her guardian, and the consent of a virgin girl should be sought regarding herself; her silence is her permission."
