Chapter: The guardian – Rejection of marriage contracts without a guardian and two just witnesses
Hadith 4075
أَخْبَرَنَا عُمَرُ بْنُ مُحَمَّدٍ الْهَمْدَانِيُّ مِنْ أَصْلِ كِتَابِهِ ، حَدَّثَنَا سَعِيدُ بْنُ يَحْيَى بْنِ سَعِيدٍ الأُمَوِيُّ ، حَدَّثَنَا حَفْصُ بْنُ غِيَاثٍ ، عَنِ ابْنِ جُرَيْجٍ ، عَنْ سُلَيْمَانَ بْنِ مُوسَى ، عَنِ الزُّهْرِيِّ ، عَنْ عُرْوَةَ ، عَنْ عَائِشَةَ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ : " لا نِكَاحَ إِلا بِوَلِيٍّ وَشَاهِدَيْ عَدْلٍ ، وَمَا كَانَ مِنْ نِكَاحٍ عَلَى غَيْرِ ذَلِكَ ، فَهُوَ بَاطِلٌ ، فَإِنْ تَشَاجَرُوا فَالسُّلْطَانُ وَلِيُّ مَنْ لا وَلِيَّ لَهُ " ، قَالَ أَبُو حَاتِمٍ : لَمْ يَقُلْ أَحَدٌ فِي خَبَرِ ابْنِ جُرَيْجٍ ، عَنْ سُلَيْمَانَ بْنِ مُوسَى ، عَنِ الزُّهْرِيِّ هَذَا " وَشَاهِدَيْ عَدْلٍ " إِلا ثَلاثَةُ أَنْفَسٍ : سَعِيدُ بْنُ يَحْيَى الأُمَوِيُّ ، عَنْ حَفْصِ بْنِ غِيَاثٍ ، وَعَبْدُ اللَّهِ بْنُ عَبْدِ الْوَهَّابِ الْحَجَبِيُّ ، عَنْ خَالِدِ بْنِ الْحَارِثِ ، وَعَبْدُ الرَّحْمَنِ بْنِ يُونُسَ الرَّقِّيُّ ، عَنْ عِيسَى بْنِ يُونُسَ ، وَلا يَصِحُّ فِي ذِكْرِ الشَّاهِدَيْنِ غَيْرَ هَذَا الْخَبَرِ .
Sayyidah Aisha Siddiqa (may Allah be pleased with her) narrates: The Prophet Muhammad (peace and blessings be upon him) said: There is no marriage without a guardian and two just witnesses; any marriage other than this will be considered invalid. And if there is a dispute among people regarding (the matter of a guardian), then whoever has no guardian, the ruler of the time is his guardian. (Imam Ibn Hibban, may Allah have mercy on him, says:) In the narration transmitted from Zuhri through Sulaiman bin Musa from Ibn Jurayj, the words "without two just witnesses" have only been narrated by three individuals: Saeed bin Yahya Umavi narrated it from Hafs bin Ghiyath; Abdullah bin Abdulwahab Hajbi narrated it from Khalid bin Harith; and Abdur Rahman bin Yunus Ruqi narrated it from Isa bin Yunus. The mention of two witnesses has not been authentically transmitted anywhere else in this narration.
