باب الكفارة - ذكر البيان بأن النبي صلى الله عليه وسلم إنما أمر المجامع في شهر الصوم بصيام شهرين عند عدم القدرة على الرقبة وبإطعام ستين مسكينا عند عدم القدرة على الصوم لا أنه يخير بين هذه الأشياء الثلاثة

حَامِدُ بْنُ مُحَمَّدِ بْنِ شُعَيْبٍ الْبَلْخِيُّ ، بِبَغْدَادَ ، قَالَ : حَدَّثَنَا
سُرَيْجُ بْنُ يُونُسَ ، قَالَ : حَدَّثَنَا
سُفِيَانُ ، عَنِ
الزُهْرِيِّ ، عَنْ
حُمَيْدِ بْنِ عَبْدِ الرَّحْمَنِ ، أَنَّهُ سَمِعَ
أَبَا هُرَيْرَةَ ، يَقُولُ : جَاءَ رَجُلٌ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ : هَلَكَتُ ، فَقَالَ : " وَمَا شَأْنُكَ ؟ " ، قَالَ : وَقَعَتُ عَلَى امْرَأَتِي ، قَالَ : " فَهَلْ تَجِدُ مَا تُعْتِقُ بِهِ رَقَبَةً ؟ " ، قَالَ : لا ، قَالَ : " أَتَسْتَطِيعُ أَنْ تَصُومَ شَهْرَيْنِ مُتَتَابِعَيْنِ ؟ " ، قَالَ : لا ، قَالَ : " أَتَسْتَطِيعُ أَنْ تُطْعِمَ سِتِّينَ مِسْكِينًا ؟ " ، قَالَ : لا ، قَالَ : " اجْلِسْ " ، فَأُتِيَ بِعَرَقٍ فِيهِ تَمْرٌ ، وَهُوَ الْمِكْتَلُ الضَّخْمُ ، قَالَ : " خُذْ هَذَا فَتَصَدَّقْ بِهِ عَلَى سِتِّينَ مِسْكِينًا " ، قَالَ : مَا بَيْنَ لابَتَيْهَا أَهْلُ بَيْتٍ أَفْقَرُ مِنَّا ، قَالَ : فَضَحِكَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ حَتَّى بَدَتْ أَنِيَابُهُ ، قَالَ : " خُذْهُ وَأَطْعِمْهُ عِيَالَكَ " .
Sayyiduna Abu Hurairah (may Allah be pleased with him) narrates: A man came to the service of the Prophet (peace and blessings be upon him). He said: I have been ruined. The Prophet (peace and blessings be upon him) asked: What has happened to you? He replied: I had intercourse with my wife while fasting. The Prophet (peace and blessings be upon him) asked: Do you have a slave whom you can free? He replied: No. The Prophet (peace and blessings be upon him) asked: Can you fast for two consecutive months? He replied: No. The Prophet (peace and blessings be upon him) asked: Can you feed sixty needy people? He replied: No. The Prophet (peace and blessings be upon him) said: Sit down. Then a basket was brought to the Prophet (peace and blessings be upon him) in which there were dates; it was a large measure. The Prophet (peace and blessings be upon him) said: Take this and give it as charity to sixty needy people. He replied: There is no family in the whole city poorer than ours. The narrator says: So the Prophet (peace and blessings be upon him) smiled until his molar teeth became visible. He said: Then take it and feed it to your family.
