أَخْبَرَنَا عَبْدُ اللَّهِ بْنُ مُحَمَّدٍ الأَزْدِيُّ ، قَالَ : حَدَّثَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ ، قَالَ : أَخْبَرَنَا عَبْدُ الرَّزَّاقِ ، قَالَ : أَخْبَرَنَا مَعْمَرٌ ، عَنْ هَارُونَ بْنِ رِئَابٍ ، عَنْ كِنَانَةَ الْعَدَوِيِّ ، قَالَ : كُنْتُ عِنْدَ قَبِيصَةَ بْنِ الْمُخَارِقِ ، فَاسْتَعَانَ بِهِ نَفَرٌ مِنْ قَوْمِهِ فِي نِكَاحِ رَجُلٍ مِنْ قَوْمِهِ ، فَأَبَى أَنْ يُعْطِيَهُمْ شَيْئًا ، فَانْطَلَقُوا مِنْ عِنْدِهِ ، قَالَ كِنَانَةُ : فَقُلْتُ لَهُ : أَنْتَ سَيِّدُ قَوْمِكَ ، وَأَتَوْكَ يَسْأَلُونَكَ ، فَلَمْ تُعْطِهِمْ شَيْئًا ، قَالَ : أَمَّا فِي هَذَا ، فَلا أُعْطِي شَيْئًا ، وَسَأُخْبِرُكَ عَنْ ذَلِكَ ، تَحَمَّلْتُ بِحَمَالَةٍ فِي قَوْمِي ، فَأَتَيْتُ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَأَخْبَرْتُهُ وَسَأَلْتُهُ أَنْ يُعِينَنِي ، فَقَالَ : " بَلْ نَحْمِلُهَا عَنْكَ يَا قَبِيصَةُ ، وَنُؤَدِّيهَا إِلَيْهِمْ مِنْ إِبِلِ الصَّدَقَةِ " ، ثُمَّ قَالَ : " إِنَّ الْمَسْأَلَةَ لا تَحِلُّ إِلا لِثَلاثٍ : رَجُلٍ تَحَمَّلَ حَمَالَةً ، فَقَدْ حَلَّتْ لَهُ ، حَتَّى يُؤَدِّيَهَا ، أَوْ رَجُلٍ أَصَابَتْهُ جَائِحَةٌ ، فَاجْتَاحَتْ مَالَهُ حَتَّى يُصِيبَ قِوَامًا مِنْ عَيْشٍ ، أَوْ سِدَادًا مِنْ عَيْشٍ ، وَرَجُلٍ أَصَابَتْهُ فَاقَةٌ ، فَشَهِدَ لَهُ ثَلاثَةٌ مِنْ ذَوِي الْحِجَا مِنْ قَوْمِهِ أَنْ قَدْ حَلَّتْ لَهُ الْمَسْأَلَةُ ، فَقَدْ حَلَّتْ لَهُ حَتَّى يُصِيبَ قِوَامًا مِنْ عَيْشٍ ، أَوْ سِدَادًا مِنْ عَيْشٍ ، وَالْمَسْأَلَةُ فِيمَا سِوَى ذَلِكَ سُحْتٌ " ، قَالَ أَبُو حَاتِمٍ : قَوْلُهُ : " وَالْمَسْأَلَةُ فِيمَا سِوَى ذَلِكَ سُحْتٌ " أَرَادَ بِهِ أَنَّ الْمَسْأَلَةَ فِي سِوَى هَذِهِ الأَشِيَاءِ الثَّلاثَةِ مِنَ السُّلْطَانِ عَنْ فَضْلِ حِصَّتِهِ مِنْ بَيْتِ الْمَالِ سُحْتٌ ، لأَنَّ الْمَسْأَلَةَ فِي غَيْرِ هَذِهِ الْخِصَالِ الثَّلاثَةِ مِنْ غَيْرِ السُّلْطَانِ عَنْ غَيْرِ بَيْتِ مَالِ الْمُسْلِمِينَ تَكُونَ سُحْتًا إِذَا كَانَ مُسْتَغْنٍ بِمَا عِنْدَهُ .
Kinanah ‘Adawi narrates: I was present with Sayyiduna Qabeesah bin Mukhaariq (may Allah be pleased with him) when some members of his tribe sought his help regarding the marriage of a man from their tribe, but he refused to give them anything. Those people got up and left him. Kinanah says: I said to him, “You are the chief of your tribe. Those people came to you asking for something, but you did not give them anything.” He replied, “As far as this matter is concerned, I will not give them anything. I will tell you about this. Once, I took responsibility for a payment on behalf of my tribe. I went to the service of the Prophet Muhammad (peace be upon him), informed him about it, and requested him to help me. The Prophet (peace be upon him) said: ‘O Qabeesah, we take the payment upon ourselves on your behalf, and will pay those people from the camels of charity.’ Then the Prophet (peace be upon him) said: ‘Asking is only permissible for three types of people: One, the person upon whom a payment is due; for him, asking is permissible until he fulfills that payment. Or, someone who is afflicted by a calamity and as a result loses his wealth; for him, asking is permissible until his basic needs are met. And one who is struck by hunger, and three wise men from his tribe testify about him that asking has become permissible for him; for such a person, asking is permissible until his basic needs are met. Other than this, asking is forbidden.’ (Imam Ibn Hibban, may Allah have mercy on him, says:): The statement of the Prophet (peace be upon him), ‘Other than this, asking is forbidden,’ means: It is forbidden to ask the ruler for anything extra from the public treasury beyond one’s specific share except for these three cases. The reason is: In cases other than these three characteristics, asking from anyone other than the ruler is not a collection from the Muslims’ public treasury. At that time, it will be forbidden when a person does not have enough that would make him independent from asking.

أَخْبَرَنَا أَحْمَدُ بْنُ عَلِيِّ بْنِ الْمُثَنَّى ، حَدَّثَنَا حَوْثَرَةُ بْنُ أَشْرَسَ الْعَدَوِيُّ ، حَدَّثَنَا حَمَّادُ بْنُ زَيْدٍ ، عَنْ هَارُونَ بْنِ رِئَابٍ ، عَنْ كِنَانَةَ بْنِ نُعَيْمٍ الْعَدَوِيِّ ، عَنْ قَبِيصَةَ بْنِ مُخَارِقٍ الْهِلالِيِّ ، قَالَ : تَحَمَّلْتُ حَمَالَةً ، فَأَتَيْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَسْأَلُهُ مِنْهَا ، فَقَالَ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " أَقِمْ يَا قَبِيصَةُ حَتَّى تَجِيئَنَا الصَّدَقَةُ ، فَنَأْمُرَ لَكَ بِهَا " ، ثُمَّ قَالَ : " يَا قَبِيصَةُ ، إِنَّ الْمَسْأَلَةَ لا تَحِلُّ إِلا لإِحْدَى ثَلاثٍ : رَجُلٍ تَحَمَّلَ بِحَمَالَةٍ ، فَحَلَّتْ لَهُ الْمَسْأَلَةُ حَتَّى يُصِيبَهَا ثُمَّ يُمْسِكَ ، وَرَجُلٍ أَصَابَتْهُ جَائِحَةٌ ، فَاجْتَاحَتْ مَالَهُ ، فَحَلَّتْ لَهُ الْمَسْأَلَةُ حَتَّى يُصِيبَ قِوَامًا مِنْ عَيْشٍ ، أَوْ سِدَادًا مِنْ عَيْشٍ ، وَرَجُلٍ أَصَابَتْهُ فَاقَةٌ حَتَّى يَقُولَ ثَلاثَةٌ مِنْ ذَوِي الْحِجَا مِنْ قَوْمِهِ : لَقَدْ أَصَابَتْ فُلانًا فَاقَةٌ ، فَحَلَّتْ لَهُ الْمَسْأَلَةُ حَتَّى يُصِيبَ قِوَامًا مِنْ عَيْشٍ ، أَوْ قَالَ : سِدَادًا مِنْ عَيْشٍ ، وَمَا سِوَاهُنَّ مِنَ الْمَسْأَلَةِ سُحْتٌ يَأْكُلُهَا صَاحِبُهَا سُحْتًا " .
Kinanah bin Na’eem ‘Adawi narrates from Sayyiduna Qabeesah bin Mukhaariq Hilaali (may Allah be pleased with him): I took responsibility for a payment, so I presented myself before the Prophet Muhammad (peace be upon him) to seek help regarding it. The Prophet (peace be upon him) said: O Qabeesah, stay where you are. When (charity money) comes to us, we will order it to be given to you. Then the Prophet (peace be upon him) said: O Qabeesah, asking (for charity) is permissible only for one of three persons: one who has a payment due upon him, for him it is permissible to ask until he pays off that debt, then he should refrain from asking; one who is struck by a calamity which destroys his wealth, for him it is permissible to ask until he fulfills his basic needs (the narrator is unsure about a word here); and one who is afflicted by hunger, until three wise men from his people testify that so-and-so has been afflicted by hunger, for him it is permissible to ask until he can fulfill his basic needs (the narrator is unsure about a word here). Other than these, asking is forbidden, and whoever asks consumes forbidden wealth.
