Chapter: Ushr (Tithe) – Ordering the Estimator to Leave a Third or a Quarter of the Dates for the Owner’s Family to Eat Fresh
Hadith 3280
أَخْبَرَنَا الْفَضْلُ بْنُ الْحُبَابِ ، حَدَّثَنَا أَبُو الُوَلِيدِ الطَّيَالِسِيُّ ، حَدَّثَنَا شُعْبَةُ ، أَخْبَرَنَا خُبَيْبُ بْنُ عَبْدِ الرَّحْمَنِ ، قَالَ : سَمِعْتُ عَبْدَ الرَّحْمَنِ بْنَ مَسْعُودِ بْنِ نِيَارٍ يُحَدِّثُ ، قَالَ : جَاءَنَا سَهْلُ بْنُ أَبِي حَثْمَةَ إِلَى مَسْجِدِنَا فَحَدَّثَنَا ، أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " إِذَا خَرَصْتُمْ ، فَخُذُوا ، وَدَعُوا الثُّلُثَ ، فَإِنْ لَمْ تَدْعُوا الثُّلُثْ ، فَدَعُوا الرُّبُعَ " ، قَالَ أَبُو حَاتِمٍ : لِهَذَا الْخَبَرِ مَعْنَيَانِ ، أَحَدُهُمَا : أَنْ يُتْرَكَ الثُّلُثُ أَوِ الرُّبُعُ مِنَ الْعُشْرِ ، وَالثَّانِي : أَنْ يُتْرَكَ ذَلِكَ مِنْ نَفْسِ التَّمْرِ قَبْلَ أَنْ يُعَشَّرَ إِذَا كَانَ ذَلِكَ حَائِطًا كَبِيرًا يَحْتَمِلُهُ .
Abdur Rahman bin Masood narrates: Sayyiduna Sahl bin Abu Hathma (may Allah be pleased with him) came to our mosque and narrated this hadith to us that the Noble Prophet (peace and blessings be upon him) said: "When you estimate the produce, then collect it and leave one third of it; if you do not leave one third, then leave one fourth." (Imam Ibn Hibban, may Allah have mercy on him, says:): This narration can have two meanings: one is that he leaves one third or one fourth from the 'ushr, and the second meaning is that before taking the 'ushr, he leaves it from the dates themselves, especially when the orchard is large.
