Chapter on Dry Ablution – Permission for one in a state of major impurity who fears harm from severe cold to pray with ablution or tayammum instead of ghusl
Hadith 1315
أَخْبَرَنَا عَبْدُ اللَّهِ بْنُ مُحَمَّدِ بْنِ سَلَمْ ، قَالَ : حَدَّثَنَا حَرْمَلَةُ بْنُ يَحْيَى ، قَالَ : حَدَّثَنَا ابْنُ وَهْبٍ ، قَالَ : أَخْبَرَنِي عَمْرُو بْنُ الْحَارِثِ ، عَنْ يَزِيدَ بْنِ أَبِي حَبِيبٍ ، عَنْ عِمْرَانَ بْنِ أَبِي أَنَسٍ ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ جُبَيْرٍ ، عَنْ أَبِي قَيْسٍ مَوْلَى عَمْرِو بْنِ الْعَاصِ ، أَنَّ عَمْرَو بْنَ الْعَاصِ كَانَ عَلَى سَرِيَّةٍ ، وَأَنَّهُ أَصَابَهُمْ بَرْدٌ شَدِيدٌ لَمْ يَرَوْا مِثْلَهُ ، فَخَرَجَ لِصَلاةِ الصُّبْحِ ، قَالَ : وَاللَّهِ لَقَدِ احْتَلَمْتُ الْبَارِحَةَ ، فَغَسَلَ مَغَابَتَهُ ، وَتَوَضَّأَ وُضُوءَهُ لِلصَّلاةِ ، ثُمَّ صَلَّى بِهِمْ ، فَلَمْا قَدِمَ عَلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، سَأَلَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَصْحَابَهُ ، فَقَالَ : " كَيْفَ وَجَدْتُمْ عَمْرًا وَأَصْحَابَهُ ؟ " ، فَأَثْنَوْا عَلَيْهِ خَيْرًا ، وَقَالُوا : يَا رَسُولَ اللَّهِ ، صَلَّى بِنَا وَهُوَ جُنُبٌ ، فَأَرْسَلَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ إِلَى عَمْرٍو فَسَأَلَهُ ، فَأَخْبَرَهُ بِذَلِكَ وَبِالَّذِي لَقِيَ مِنَ الْبَرْدِ ، وَقَالَ : يَا رَسُولَ اللَّهِ ، إِنَّ اللَّهَ قَالَ : وَلا تَقْتُلُوا أَنْفُسَكُمْ سورة النساء آية 29 ، وَلَوِ اغْتَسَلْتُ مُتُّ ، فَضَحِكَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ إِلَى عَمْرٍو .
Abu Qais, who was the servant of Sayyiduna Amr ibn al-As (may Allah be pleased with him), narrates: Sayyiduna Amr ibn al-As (may Allah be pleased with him) was also on an expedition. The people faced such severe cold that they had never experienced such cold before. Sayyiduna Amr ibn al-As came for the morning prayer and said, "Last night I had a wet dream," so he washed his private parts and performed ablution as for prayer, and led the people in prayer. When he presented himself before the Noble Prophet (peace and blessings be upon him), the Noble Prophet (peace and blessings be upon him) asked his companions, "How did you find Amr and his companions?" The people praised him and mentioned this matter. "O Messenger of Allah, he led us in prayer while in a state of major ritual impurity." So the Noble Prophet (peace and blessings be upon him) called Sayyiduna Amr and asked him, and Sayyiduna Amr informed him and told him about the cold he had faced. He said, "O Messenger of Allah! Allah Almighty has said: 'Do not kill yourselves.' If I had performed ghusl, I would have died." The Noble Prophet (peace and blessings be upon him) laughed at the statement of Sayyiduna Amr.
