Chapter on Nullifiers of Ablution – Clarification that the narrations mentioned are general, and ablution is only required after touching the male organ
Hadith 1118
أَخْبَرَنَا عَلِيُّ بْنُ الْحُسَيْنِ بْنِ سُلَيْمَانَ الْمُعَدَّلُ ، بِالْفُسْطَاطِ ، وَعِمْرَانُ بْنُ فَضَالَةَ الشَّعِيرِيُّ بِالْمَوْصِلِ ، قَالا : حَدَّثَنَا أَحْمَدُ بْنُ سَعِيدٍ الْهَمْدَانِيُّ ، قَالَ : حَدَّثَنَا أَصْبَغُ بْنُ الْفَرَجِ ، قَالَ : حَدَّثَنَا عَبْدُ الرَّحْمَنِ بْنُ الْقَاسِمِ ، عَنْ يَزِيدَ بْنِ عَبْدِ الْمَلِكِ ، وَنَافِعِ بْنِ أَبِي نُعَيْمٍ القارئ ، عَنِ الْمَقْبُرِيِّ ، عَنْ أَبِي هُرَيْرَةَ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " إِذَا أَفْضَى أَحَدُكُمْ بِيَدِهِ إِلَى فَرْجِهِ ، وَلَيْسَ بَيْنَهُمَا سِتْرٌ وَلا حِجَابٌ ، فَلْيَتَوَضَّأْ " . قَالَ أَبُو حَاتِمٍ رَضِيَ اللَّهُ عَنْهُ : احْتِجَاجُنَا فِي هَذَا الْخَبَرِ بِنَافِعِ بْنِ أَبِي نُعَيْمٍ دُونَ يَزِيدَ بْنِ عَبْدِ الْمَلِكِ النَّوْفَلِيِّ لأَنَّ يَزِيدَ بْنَ عَبْدِ الْمَلِكِ تَبَرَّأْنَا مِنْ عُهْدَتِهِ فِي كِتَابِ الضُّعَفَاءِ .
Sayyiduna Abu Hurairah (may Allah be pleased with him) narrates: The Noble Prophet (peace and blessings be upon him) said: "When a person extends his hand towards his private part and there is no barrier or obstruction between the two, then that person should perform ablution." (Imam Ibn Hibban, may Allah have mercy on him, says:) Our argument in this narration is based on the narration transmitted by Nafi' bin Abu Nu'aym, not on the narration transmitted by Yazid bin Abdul Malik, because we are absolved from considering Yazid bin Abdul Malik as reliable. As this has been mentioned in the book al-Du'afa.
