Hadith 515
أَخْبَرَنَا
مُحَمَّدُ بْنُ الْحَسَنِ بْنِ قُتَيْبَةَ ، قَالَ : حَدَّثَنَا
مُحَمَّدُ بْنُ رُمْحٍ ، قَالَ : حَدَّثَنَا
اللَّيْثُ بْنُ سَعْدٍ ، عَنْ
مَالِكِ بْنِ أَنَسٍ ، عَنِ
الزُّهْرِيِّ ، عَنِ
الأَعْرَجِ ، عَنْ
أَبِي هُرَيْرَةَ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " لا يَمْنَعَنَّ أَحَدُكُمْ جَارَهُ أَنْ يَغْرِزَ خَشَبَةً عَلَى جِدَارِهِ " قَالَ ابْنُ رُمْحٍ : سَمِعْتُ اللَّيْثَ ، يَقُولُ : هَذَا أَوَّلُ مَا لِمَالِكٍ عِنْدَنَا وَآخِرُهُ ، قَالَ أَبُو حَاتِمٍ : فِي قَوْلِ اللَّيْثِ : هَذَا أَوَّلُ مَا لِمَالِكٍ عِنْدَنَا وَآخِرَهُ ، دَلِيلٌ عَلَى أَنَّ الْخَبَرَ الَّذِي رَوَاهُ قُرَادٌ ، عَنِ اللَّيْثِ ، عَنْ مَالِكٍ ، عَنِ الزُّهْرِيِّ ، عَنْ عُرْوَةَ ، عَنْ عَائِشَةَ ، قِصَّةُ الْمَمَالِيكِ خَبَرٌ بَاطِلٌ لا أَصْلَ لَهُ .
Sayyiduna Abu Hurairah, may Allah be pleased with him, narrates: The Prophet Muhammad, peace and blessings be upon him, said: "No person should ever prevent his neighbor from placing a beam in his wall." Ibn Rumh says: I heard Layth narrating this. This is the first and last narration we have from Imam Malik on this authority. (Imam Ibn Hibban, may Allah have mercy on him, says: Layth's statement that this is the first and last narration we have from Imam Malik on this authority is evidence that the narration which Qirad narrated from Layth, from Imam Malik, from Zuhri, from Urwah, and from Sayyidah Aisha, may Allah be pleased with her, in which there is mention of the share of slaves, is a fabricated narration, which has no basis.)
