ابْنُ شِهَابٍ ، عَنِ
ابْنِ الْمُسَيِّبِ ، عَنْ
أَبِي هُرَيْرَةَ : " أَنَّ امْرَأَةً مِنْ بَنِي لِحْيَانَ ضَرَبَتْ أُخْرَى كَانَتْ حَامِلا ، فَأَمْلَصَتْ ، فَقَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي إِمْلاصِ الْمَرْأَةِ بِغُرَّةٍ : عَبْدٍ أَوِ أَمَةٍ ، قَالَ : فَتُوُفِّيَتِ الْمَرْأَةُ الَّتِي عَلَيْهَا الْعَقْلُ : فَقَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّ الْعَقْلَ عَلَى عَصَبَتِهَا ، وَأَنَّ مِيرَاثَهَا لِزَوْجِهَا وَابْنِهَا " .
Sayyiduna Abu Hurairah (may Allah be pleased with him) narrates: A woman from Banu Lihyan struck another woman who was pregnant, causing her child to be miscarried. The Prophet (peace and blessings be upon him) ruled that as compensation for the loss of the child, a slave man or woman should be given. The narrator states: Then the woman who was liable to pay the compensation died, so the Prophet (peace and blessings be upon him) ruled that the payment of her compensation would be obligatory upon her 'asaba (male relatives), while her inheritance would go to her husband and sons.
