Sayyiduna Mughirah bin Shu’bah (may Allah be pleased with him) narrates: A man from the tribe of Huzail had two wives who fought with each other. One of them struck the other with a stone or with a tent pole, causing the other’s pregnancy to be lost. This case was brought before the Prophet (peace and blessings of Allah be upon him), and he (peace be upon him) ruled that a slave (male or female) should be given as compensation. The guardian of the woman said: Should I pay compensation for one who neither cried out nor wailed, who neither drank nor ate anything? The Prophet (peace and blessings of Allah be upon him) said: Is he using rhymed prose like that of the time of ignorance? Then the Prophet (peace and blessings of Allah be upon him) made the payment of compensation obligatory upon the woman’s guardians.
